This position will work closely with the Litigation Director to provide legal support to the department and help coordinate with other departments. Reviews investigations for determination of violation of board rules and statutes. Reviews evidence to include statements, records, expert reports, and responses and drafts settlement documents. Attends and represent staff at informal settlement conferences. Assists the department with drafting of surrender/revocation orders and letters, and cancellation and retirement documents for licensees that are under active investigation. PRINCIPAL JOB DUTIES AND RESPONSIBILITIES70% Evaluates cases referred to the legal department and drafts appropriate documents including orders, remedial plans, suspension and revocation letters, and other settlement orders. Prepares cases for informal settlement conferences (ISC) and represents Board Staff at ISCs. Prepares for and represents Board Staff at hearings including suspension hearings, default hearings, and other public hearings. 20% Reviews new investigation files related to the unlicensed practice of medicine and drafts and negotiates settlement orders. For cease-and-desist cases referred to the Litigation Department, updates settlement orders, prepares case for hearing, and represent board staff at the hearing. 10% Conducts legal research and drafts research and policy documents to support the litigation department. Assists the Litigation Director in drafting and organizing other internal documents to support the department. Reviews expunction orders and expunges internal documents as appropriate. Other job duties as assigned. KNOWLEDGE, SKILLS, AND ABILITIES Graduation from an accredited law school with an L.L.B. or J.D. degree. Licensed in good standing to practice law in Texas or currently awaiting Texas Bar Exam results. Applicants taking the July Texas Bar Exam and awaiting Texas Bar Exam results are eligible to apply, employment after bar results are announced will be contingent upon bar passage. REQUIRED EXPERIENCE AND EDUCATIONKnowledge of legal principles and practices of law related to the licensing and regulation of professional licensees, specifically licensees engaged in health care. Knowledge of applicable law and Board rules regarding licensees of the agency. Knowledge of legal principles and practices of law related to development of cases for litigation and prosecution.
