Direct Care and Treatment (DCT) is seeking an individual to join our DCT General Counsel's Office for an exciting and rewarding opportunity as an Associate General Counsel - Staff Attorney 1! This position will provide legal advice and related services to DCT for support services issues that have an impact on operations. This position will provide legal advice in a variety of complex and changing areas, applicable to the diverse activities of DCT divisions and facilities. Specifically, the individual provides legal advice on issues including, but not limited to, the Minnesota Commitment and Treatment Act; data privacy; protected health information; operations at DCT facilities; decisional capacity and due process relating to administration of neuroleptic medication and other treatment; Jarvis, guardianships, and substitute decision maker proceedings, and legal review of policies.
Primary Responsibilities:
Provide legal advice, policy information, and analysis so that DCT policies and practices are consistent with legal requirements and the legal and policy information and analysis needed on these subjects is available.
Review and draft proposed legislative changes and provide legal advice and services to proposed legislative changes affecting DCT.
Conduct legal review of DCT umbrella policies to ensure consistency with other DCT policies, applicable statutes, rules, regulations, licensing requirements, and regulatory standards.
Develop and conduct training on legal policies.

Minimum Qualifications
To be qualified for and considered for this position, applicants must meet all the minimum qualifications listed below. JD degree from an ABA accredited law school; AND
Current license and in good standing to practice law in Minnesota; AND
One (1) year experience as a practicing attorney in civil commitment, health care, privacy, or a related field. Experience from an externship, student clinic, or similar, in civil commitment, health care, privacy or related field may substitute for up to 6 months. Experience must demonstrate the following:
Experience providing legal advice interpreting rules, laws, court orders and other legal and/or regulatory materials.
Experience with the legislative process and federal and state laws.
Preferred Qualifications
Possess knowledge of state and federal law, rules, and regulations relating to the Minnesota Commitment and Treatment Act, the Minnesota Uniform Probate Code (specifically the Minnesota Guardianship Act), the Minnesota Health Records Act, the Minnesota Vulnerable Adults Act, the Minnesota Maltreatment of Minors Act, the Health Insurance Portability and Accountability Act, and the Minnesota Government Data Practices Act.
Experience identifying statutes and rules that apply to individual situations and experience advising decision-makers of the legal consequences for actions or failures to act in compliance with applicable statutes and rules.
Experience determining the impact of proposed or adopted changes in state or federal law, rule or regulation that impact a treatment facility or program.
