Description of Job
The Step 3 Grievance Responder examines complex issues affecting entire prison populations or individual offenders by researching policies, case law and legal principles in a wide range of topics including, but not limited to, property, staff conduct, case management, offender mail, housing conditions, medical, mental health, ADA, co-pay refunds, religious rights, canteen and food service. Independently analyze, investigate and determine underlying issue of allegations, taking into consideration mitigating and extenuating circumstances.
Independently provides succinct written responses pursuant to legal standards, administrative regulations, and sensitivity to the correctional setting. Determines final administrative decisions and recommendations at the final Step 3 level on behalf of the Step 3 Grievance Officer by reviewing and implementing constitutional law, corrections processes, established case law, and legal principles. Independently determines whether all administrative remedies have been exhausted to offender, as mandated under the Prison Litigation Reform Act. Monitor compliance of grievance program to maintain constitutional standards to include review of changes to and implementation of federal, state, local law and regulations.
Primary job duties and responsibilities include but are not limited to:
Determine if claims presented by offenders in each grievance are viable and entitled to relief by investigating, compiling and assembling information into an understandable format, to prepare a written response using legal standards and principals in making the determination;
Independently review grievance responses and exhibits made by the Step 1 and Step 2 responders by advising and guiding responders to appropriate and correct written responses when necessary;
Educate and guide responders in understanding procedural errors and how they should be addressed in grievance responses by referring staff to appropriate administrative regulations and providing them with expertise examples and information;
Make recommendations to facilities of the appropriate applications of grievance procedures and guidelines using discretion and expert knowledge;
Skillfully utilizes discretion and judgment in making recommendations to facilities in the appropriate applications of grievance procedures and guidelines;
Monitor compliance of legal standards and policies within the grievance program by advising and educating staff of appropriate administrative regulations and federal, state and local law; report non-compliance and/or gross inadequacies to facility supervisors with recommendations for resolution;
Independently contact wardens and other facility staff with discretion and tact about issues that may be managed differently insofar as maintaining compliance within legal guidelines;
Respond to wardens and high administrative staff seeking advice/counsel and direction on issues affecting large segments of offender population or individual offender issues;
Respond to questions and issues raised by facility grievance coordinators by advising and clarifying program policies and procedures and effective use of the grievance database to maintain continuous compliance of the grievance standards as mandated by law and departmental regulations;
Other duties as assigned.

MINIMUM QUALIFICATIONS
Six (6) years of relevant experience in grievances, investigations or legal standards and processes.

A combination of education and relevant experience as listed above equal to six (6) years.

Experience with policy drafting, review, recommendations, and development for governmental, correctional, and/or organizational entity;
Experience with Adobe Pro or similar;
Experience with electronic documentation;
Comprehensive knowledge of Federal and State guidelines to ensure compliance with policy development;
Experience as an auditor.

Have NO felony convictions, to include any actions defined in 5 U.S.C. 301; U.S.C. 509, 510; 42 U.S.C. 15601-15609. The CDOC shall not hire nor promote anyone who may have contact with an offender who has engaged in sexual abuse which includes acts, activity, and sexual behavior, in a prison or other institution as defined in 42 U.S.C. 1997; or has been convicted of engaging or attempting to engage in sexual activity in the community facilitated by force, overt or implied threats of force or coercion, or if the victim did not consent or was unable to consent or refuse, or has been civilly or administratively adjudicated to have engaged in the activity described in the above paragraph. The agency shall consider any incidents of sexual harassment in determining whether to hire anyone who may have contact with offenders or residents.

Successfully pass all modules of the six-week Colorado Department of Corrections Basic Training, to include English reading comprehension , relevant competency assessments and written/practical exams in Defensive Tactics.
Possess the physical ability to successfully complete Defensive Tactics
Lift arms above head and kick as high as own waist
Stabilize another person to accomplish a controlled take down
Use arms, palms of hands, shins, and feet to deliver blows
Withstand impact (slow speed or with a safety bag) on own body from strikes/blows
Swing a baton in a striking technique
Rotate body 90 degrees with feet planted for striking with foot or using a defensive tactic;
Get down on one or both knees and up again with multiple repetitions
Will be exposed to Oleoresin Capsicum during Basic Training and will be exposed while on assignment
Must be able to see and hear in order to observe, address and respond to potential breaches in safety and security
Seize, hold, control or subdue violent or assaultive persons and defend oneself or others to prevent injury
Demonstrate body agility, strength of all four limbs and the ability to walk and climb stairs consistently
Work in situations involving assaultive behavior, physical control of another person and/or restraint situations
Deal with individuals with a range of moods and behaviors, utilizing tactfulness and a congenial, personable manner

Successful completion of a background investigation is required. Should applicant's background reveal criminal charges, it shall be the responsibility of the applicant to provide the Department of Corrections with written/official disposition of any charges.
The CDOC is committed to a work environment free from illegal drugs and alcohol. A drug test will be administered to all new employees; employees must successfully pass. Random drug screening will occur throughout employment.
