Job Summary :
Reporting to the Deputy Chief Diversity Officer, MWDBE/SDVOB Contract Compliance, the Assistant Deputy Chief Diversity Officer ("ADCDO") serves as the day-to-day operational lead and second-in-command for the MWDBE/SDVOB Contract Compliance function across the MTA Department of Diversity & Civil Rights ("DDCR"). This role oversees the Senior Directors and their staff, drives goal setting, monitoring, enforcement, contractor evaluations, and project closeouts; ensures accurate reporting to the MTA Board and external regulators; and partners with operating agencies to resolve MWDBE/SDVOB issues across procurement and capital programs. The ADCDO is also directly responsible for ensuring that staff in the DDCR Contract Compliance Unit receive adequate training for both professional development and required field work and site visits. The ADCDO will have direct contact with outside regulatory, law enforcement, and general stakeholders and ensure that files are complete and responses are effective and properly vetted for the MTA Inspector General's Office, MTA Internal Audit, the New York State Attorney General's Office, the United States Department of Transportation, and other regulatory and enforcement agencies. Assumes the duties of the Deputy Chief Diversity Officer when the incumbent for that position is absent or otherwise unavailable.
Responsibilities:
Drafts and determines the completeness of the DDCR Contract Compliance Units' Standard Operating Procedures and other internal procedures. Instructs and guides Compliance Managers to follow the required procedures and regulations.
Manage/direct the process for establishing realistic MWDBE/SDVOB participation goals for all competitive MTA contract activities, and ensure staff have properly vetted applicable information to set appropriate goals.
Manage the compliance of all MWDBE/SDVOB goals (by contract), both by the percentage of the goal achieved by the applicable contractors and by compliance with program regulations.
Manage/direct and coordinate the compliance by MTA bidders/proposers/contractors/user departments/contract managers and MWDBE/SDVOB firms on all competitively let contracts.
Determines the overall strategy to properly maintain and review a collective portfolio of approximately 1,000 DDCR monitored contracts. Determines with full authority which issues or concerns need to be escalated to the Deputy Chief Diversity Officer.
Ensures that all firms that have completed projects are evaluated within the ACE and KPI Performance Evaluation systems.
Ensures Prime Contractor's and Subcontractor's compliance with applicable federal and state regulations, policies/procedures, and contract provisions. Has decision-making authority to decide on actions to take for non-compliant or otherwise underperforming contractors.
Perform liaison role on behalf of DDCR with MTA agencies to respond to alleged violations of rules, regulations, policies, and procedures related to the MWDBE and SBD Programs by evaluating or recommending the initiation of investigative procedures on MWDBE and SDVOB regulatory issues.
Serves as point of contact with MTA Audit Services and the Inspector General's Office on MWDBE/SDVOB-related matters involving commercial useful function, fraud, and other related matters.
Work in conjunction with the MTA's Operating Agency Procurement, Capital Program, and Engineering staff to ensure appropriate participation of certified MWDBEs/SDVOBs in the procurement processes to conform with regulations.
Monitoring the performance of project-level MWDBE/SDVOB staff in meeting the goals established by each contract for the entire life of the project, including reviewing and auditing documentation in project-level MWDBE/SDVOB electronic files, assessing the sufficiency of Good Faith Efforts, and meeting with the project MWDBE/SDVOB managers to review the MWDBE/SDVOB Participation Plan and the progress of the participating firms.
Work with the Business and Diversity Initiatives unit to continually source, enhance, and update the number of participating firms in the Small Business Development and Mentoring Programs and other procurement opportunities.
Works in conjunction with the various MTA Operating Agencies' Chief Engineers and staff in ensuring that MWDBE/SDVOB goals are achieved and that projects are officially closed.
Establish, implement, and support contract monitoring systems.
Addresses certified subcontractor complaints and assesses whether the issue can be addressed by the assigned staff or needs to be elevated to the Deputy Chief Diversity Officer.
Required Education and Experience:
Bachelor's Degree in Arts/Sciences (BA/BS) in a related field.
Minimum 11 years of experience with a proven understanding of research techniques, including data collection, data analysis, issue identification, and problem resolution. An equivalent combination of education and experience may be considered in lieu of a degree.
The Following is/are preferred:
MTA MW/DBE/SDVOB Contract Compliance Experience is preferred.

Travel may be required to other MTA locations or other external sites.
