OPIC works on the Commissioners side of the agency and provides independent recommendations to the Commissioners as they establish overall agency direction and policy and make final determinations on contested permitting and enforcement matters.See details about what we do.HEREand#8217;S WHAT YOUand#8217;LL BE DOINGAttorney IRepresent the Office of Public Interest Counsel in administrative hearings, public meetings, agency agenda meetings, and at alternative dispute resolution proceedings.
Conduct legal research; prepare legal opinions and briefs.
Advisethe Public Interest Counsel on the interpretation of applicable state laws and agency rules.
Participate in agency rulemaking proposals by conducting reviews and analysis and provides recommendations to the commission. Respond to requests from the public for information on general litigation and case-specific matters.Attorney IIRepresent the OPIC as a party in all phases of complex contested cases throughout the state.
Develop and deliver presentations or briefs on complex legal and regulatory issues in a variety of forums, including public meetings, contested case hearings, and Commission Agenda meetings.
Complete related tasks including the analysis of proposed rules and pending legislation, mentoring activities for newer attorneys, and participate in intra-agency workgroups.
Participate in Alternative Dispute Resolutionprocessesas mediator or party.Attorney IIIRepresent the OPIC as a party in all phases of prolonged, complex, or unusual contested cases throughout the state.
Develop and deliver presentations or briefs on complex legal and regulatory issues in a variety of forums, including public meetings, contested case hearings, and Commission Agenda meetings.
Complete related tasks including the analysis of proposed rules and pending legislation, mentoring activities for newer attorneys, and participation in intra-agency workgroups.
Participate in Alternative Dispute Resolution proceedings as mediator or party.Attorney IVDevelop, analyze, and provide formal comment on proposed legislation and rules related to the agencyand#8217;s regulatory authority; and serve as a liaison with other agency offices concerning legislation and rulemaking projects in which OPIC participates.
Represent the office in administrative hearings on highly complex, controversial, and significant permit applications, or other matters the Commission refers to the State Office of Administrative hearings.
Assist the director with the training and professional development of staff attorneys within the office; and assist with reviewing and assigning tasks to attorneys and mentoring staff.
Participate in special projects and administrative tasks for the office, to include assisting the director in planning, coordinating, and/or overseeing the administrative functions of the office.
Qualifications: REQUIRED EDUCATION EXPERIENCEAttorney IAdmission to the State Bar of Texas.Attorney IIAdmission to the State Bar of Texas plus three years of full-time experience in the practice of law, or employment in a responsible position involving legal work as a primary duty, or one year six months in the practice of environmental law or employment involving environmental legal issues.ORCareer Ladder Progression: One year and six months of full-time experience as anAttorney I for the TCEQ.Attorney IIIAdmission to the State Bar of Texas plus five years of full-time experience in the practice of law, or employment in a responsible position involving legal work as a primary duty or three years of full-time experience in the practice of environmental law or employment involving environmental legal workORCareer Ladder Progression: One year six months of full-time experience as an Attorney II for the TCEQ.Attorney IVAdmission to the State Bar of Texas plus seven years of full-time experience in the practice of law, or employment in a responsible position involving legal work as a primary duty or five years of full-time experience in the practice of environmental law or employment involving environmental legal work.ANDSatisfaction of one or more of the following criteria:1) Meets six of nine Attorney IIIB career ladder knowledge, skills, and abilities criteria; or2) Demonstrates exceptional knowledge of highly complex area or subject matter, anda) reports directly to Assistant Division Director;b) routinely acts in place of Senior Attorney or other high-level supervisor or;c) supervises the work of other attorneys in the demonstrated area of expertise.Employees in this classification series may research, work on, or have access to critical infrastructure, including but not limited to a communication infrastructure system, cybersecurity system, electric grid, hazardous waste treatment system, or water treatment facility. See Tex. Business Commerce Code Section 117.001(2).
