This position is temporary and includes full state fringe benefits; the position is expected to last up to two (2) years.
This position exists to provide legal advice and expertise to the Department of Human Services (DHS) on data privacy, data security, and related issues as a member of the Privacy Office. The individual in this position will be responsible for providing the Department, senior leaders, and staff with legal advice and expertise to support the Department's compliance with all applicable state and federal privacy laws, in collaboration with other Privacy Office and General Counsel's Office staff. The individual in this position will conduct legal and policy research and analysis and provide advisement on diverse and complex matters, including, but not limited to, state and federal laws and policies governing data privacy and security matters as they relate to the Department in its policymaking and provision of programs, services, and health care; legislative efforts; contracts and data sharing agreements; investigations and audits; involvement in litigation; privacy and security trainings; and compliance with policies and controlling legal authority.
Responsibilities include but may not be limited to:
Conduct legal analysis of data privacy and security incidents involving Department data.
Support the Privacy Office work of the Department of Human Services by conducting legal and policy research and analysis on diverse and complex matters to produce written products that collect and apply research on data privacy, data security, and related legal issues concerning the Department.
Provide legal advice to DHS General Counsel staff and Department directors, managers, and staff on data privacy issues and related legal issues within the Department.
Minimum Qualifications
Staff Attorney 1:
JD degree from an ABA accredited law school;
Current license and in good standing to practice law in the State of Minnesota; and
At least one (1) year experience as a practicing attorney in, or related to data privacy law; and
Demonstrates knowledge and experience conducting legal research, writing and analysis; and providing legal advice.
Staff Attorney 2:
JD degree from an ABA accredited law school;
Current license and in good standing to practice law in Minnesota; and
At least three (3) years' experience as a practicing attorney in or related to data privacy law.
AND
Experience must also demonstrate the following:
Strong legal research, analysis, and writing skills.
Building and maintaining good working relationships with internal and external stakeholders.
Providing legal advice on diverse and complex human services and data privacy matters
Experience in one or more areas of law related to the position.
Demonstrated experience with regulations and policies relating to Minnesota state government data practices and administrative law.
Preferred Qualifications
Ability to spot potential issues in the content of the contract, as well as potential violations of state and federal contracting statutes and regulations.
Knowledge and ability necessary to successfully conduct extremely complex work which includes the analysis and application of federal and state laws, regulations, agency rules, policy, hearing procedures, rules of evidence, codes and case law.
Experience working for a government agency/organization.
Variety of experiences working effectively with others from different backgrounds and cultures.
