Go to CAPPS Recruit to Sign In https://capps.taleo.net/careersection/ex/jobsearch.ftl?lang=enGENERAL DESCRIPTION: Perform moderately complex (journey-level) supervisory, technical, administrative and regulatory work in conjunction with the Motor Carrier Compliance Audit (MCCA) and Motor Carrier Safety Section (MCS) Sections of the Motor Carrier Bureau to accomplish compliance with the State and Federal commercial motor vehicle safety laws and enforcement activities regarding violations of Motor Carrier Safety Regulations and/or Hazardous Materials regulations detected during Compliance Review (CR) Audits. Provide technical legal advice and analyses relevant to the Compliance Review Audit Program, to the MCS Section, to the Manager of the Motor Carrier Bureau and to the staff of the Chiefand#8217;s Office in the Texas Highway Patrol Division. Work under general supervision, with moderate latitude for and expectation of the exercise of independent judgment and discretion to comply with the statutory and Department mandates concerning the Compliance Review Audit Program.The following Military Occupational Specialty codes are generally applicable to this position.https://hr.sao.texas.gov/Compensation/MilitaryCrosswalk/MOSC_Legal.pdfESSENTIAL DUTIES / RESPONSIBILITIES: 1.Analyze Motor Carrier Safety Regulations and distribute synopses of the results to MCCA and MCS staff and to Commercial Vehicle Enforcement staff to facilitate the operation of the Departmentand#8217;s Compliance Review (CR) Audit program and to ensure the Departmentand#8217;s compliance with the requirements of operative grants.2. Examine the technical and legal aspects of all administrative enforcement cases processed by the MCCA Section to ensure that investigative procedures were properly conducted, that the penalties assessed are within allowable statutory guidelines and that they are determined through uniform application of Department policy.3. Examine the technical and legal aspects of the implementation and maintenance of the MCS program to ensure that the program meets the Federal and State statutory guidelines.4. Develop, review, recommend and oversee the implementation of Department policies, procedures and methods to administer the CR Audit program and the MCS program in accordance with federal and state laws, administrative rules and legislative mandates.5.Analyze applicable phases of the CR Audit program, the MCS program, Motor Carrier Safety Regulations, Hazardous Materials Regulations, administrative rules and proposed legislation to advise the Manager of the Motor Carrier Bureau, Office of General Counsel and Regional Chain of Command of the Commercial Vehicle Enforcement Service of alternatives, impacts and risks that apply to various operations and action plans.6. Supervise assigned employee to accomplish MCCA Section objectives efficiently and effectively; develop performance standards and compare individual employeeand#8217;s performance in relation to those standards, evaluate assigned employee performance, and counsel assigned employees performance. Train or monitor initial training and retraining of assigned employees, schedule and assign work tasks, adjust task priorities as necessary, originate personnel action forms as appropriate, approve corrective disciplinary actions as necessary, approve assigned employee time off, process and maintain employee records as necessary. Participate as a member or chair of selection boards to recommend selection of applicants for open positions, and select board members to interview applicants for open positions, prepare or verify accuracy and compliance in hiring employees.7.Assure compliance of the Motor Carrier Bureau with Department procedures for proper distribution of information with the provisions of the Public Information Act, security policies, and other relevant rules and procedures. Examine requests for information from attorneys, citizens, representatives of other state or federal agencies, and Department employees for copies of various documents related to commercial motor vehicles, commercial motor vehicle carriers, and the CR program, compare requests with established guidelines for release of such information, and approve or reject release of requested information. Coordinate with the Office of General Counsel to obtain opinions from the Office of the Attorney General in Texas regarding the Public Information Act and its application to information requested.8.Monitor the preparation of certified documents to assure completeness and absolute accuracy of data contained in them and associated documents; approve the documents for certification signature.9.Draft and propose approval of administrative rules and of legislation necessary to accomplish the objectives of the CR Audit program and the MCS program; draft and submit requests to the United States Department of Transportation for interpretations of the federal Motor Carrier Safety and Hazardous Materials Regulations; draft and submit comments to appropriate agencies regarding administrative rules at both federal and state levels of government.10. Participate as a member of the standing committee on Compliance Review Audit Program for the purpose of drafting and implementing statewide policy, procedure and protocols to ensure statewide uniformity in administration of the CR Audit Program. Participates in other committees or work groups as assigned.11. Study state and federal policies, guidance memoranda, training procedures and legal interpretations relevant to conducting CR Audits and Federal Motor Carrier Safety Regulations to maintain knowledge of their current content and intent.12. Communicate extensively with federal, state, and local regulatory agencies, industry groups and associations and the public-at-large concerning Motor Carrier Safety Regulations, applicable laws and commercial motor vehicle safety issues; speak before various public groups concerning commercial motor vehicle safety issues and motor carrier safety regulations.13. Represent the MCB position for MCCA enforcement cases at informal hearings and represents the Department for MCCA enforcement cases before the State Office of Administrative Hearings (and#8220;SOAHand#8221;). Advise Department officials, in coordination with the Departmentand#8217;s Office of General Counsel, concerning enforcement case development and execution; testify as Stateand#8217;s witness in formal legal proceedings involving an appeal from SOAH or legal proceedings other than at SOAH.14. Coordinate collection proceedings of delinquent penalty amounts with the Office of the Attorney General in Texas and advise and assist MCCA section employees regarding impoundment, bankruptcy and other relevant legal issues regarding penalty collection.15. Travel throughout the state and occasionally outside the state to perform various research, investigative, training, negotiation and related functions as need
