Indiana Department of Environmental Management (IDEM):
Our mission is to implement federal and state regulations to protect human health and the environment while allowing the environmentally sound operations of industrial, agricultural, commercial, and governmental activities vital to a prosperous economy. We issue air, water, and solid and hazardous waste permits that restrict discharges to environmentally safe levels. Staff members inspect and monitor regulated entities; provide compliance and technical assistance; monitor and assess air, land, and water quality; use enforcement actions as necessary to ensure compliance; and respond to incidents involving spills to soil or waters of the state.
Role Overview:
The Environmental Manager 2 position in the Office of Land Quality's (OLQ) enforcement section manages enforcement cases to ensure that regulated entities achieve compliance with laws, rules, and permits to ensure protection of human health and environment and ensure a level playing field for regulated entities. Specifically, the EM2 case manager evaulates enforcement referrals, drafts enforcement documents, negotiates with regulated entities, and resolves enforcement actions in a timely and appropriate manner. The EM2 must have the ability to communicate effectively both verbally and in writting. In addition to providing guidance to the regulated community, the EM 2 must have the ability to interact with a diverse group of people and entities and must be able to remain professional in confrontation situations, including testifying as a technical and administrative expert witness in administrative and civil proceedings. The EM2 works closely with OLQ compliance, permit, engineering, and geology, and legal staff in formulating remedial action plans, estabishing schedules of compliance. The EM2 receives enforcement referrals from numerous different regulations, including but not limited to, hazardous waste, industrial waste, solid waste, land application, confined feeding operation, underground storage tank, leaking underground storage tank, and spills. Strong knowlege and experience in the use of computer databases, spreadsheets, and wordprocessing is necessary.
Salary Statement:
The salary for this position traditionally starts at $53,222.00 but may be commensurate with education or work experience.
Essential Duties/Responsibilities:
The EM 2 must work independently to evaluate enforcement referrals, analyze problems, and recommend a course of action.
Gather evidence, formulate remedial action plans, establish schedules of compliance, prepare supporting documentation, and enforcement documents.
Calculate and recommend to supervisor appropriate civil penalties in cases.
Negotiate settlements with regulated entities and attorneys.
Serve as an expert witness in administrative and civil proceedings.
Serve as a technical and administrative expert, providing guidance to the regulated community.
Manage the enforcement tracking system (METS) in order to ensure proper case tracking and reporting to EPA.
Participate in technical meetings on compliance issues and remediation.
Perform other duties as assigned.
Job Requirements:
Broad knowledge of and ability to interpret and adapt the principles, practices and theories of public and environmental health.
Detailed knowledge of the land program and the functions and interaction of the compliance monitoring, emergency response, enforcement and permitting areas.
Knowledge of the various rules handled by OLQ including hazardous waste, industrial waste, solid waste, land application, spills, underground storage tanks, leaking underground storage tanks, CAFOs, and CFOs.
A valid Indiana driver's license is required.
Minimum of bachelor's degree.
Ability to deal tactfully and persuasively with a variety of individuals including colleagues, general public, other government entities, consulting firms, attorneys, and regulated entities.
Ability to communicate effectively both verbally and in writing.
Ability to prepare reports and documents necessary to accomplish the program objectives in accordance with regulations and policy.
Ability to negotiate with regulated entities and/or attorneys concerning the terms and conditions specified or proposed in the various legal documents generated in the enforcement process.
Ability to develop and implement procedures independently to ensure that drafting, resolving, and tracking enforcement cases through completion is accomplished within the required timeframes.
Ability to testify in legal proceedings.
Knowledge and experience in the use of computer databases and word processing.
Periodic conferences, training courses, and workshops are attended to keep current with various issues
