Qualifications: GENERAL DESCRIPTION
Performs highly complex legal work in the prosecution of quality-of-care enforcement cases at Informal Settlement Conferences (ISC). Develop prosecution strategy for complex cases involving advanced medical issues and negotiate agreed settlement orders. Work involves litigation practice with extensive legal writing and complex quality of care issues requiring knowledge of medicine. Work under general direction from the Director of Litigation, with extensive latitude for the use of initiative and independent judgment. Files complex quality of care cases at SOAH, including mediation of cases that do not resolve following ISC.
Performs moderately complex work assisting attorneys by reviewing summaries of allegations, agreed orders and remedial plans. Reviews and maintains the ISC docket, including managing and tracking deadlines and docket workflow. Works under Director of Litigation with latitude and moderate amount of independent judgment.
EXPERIENCE AND EDUCATION
Graduation from an accredited law school with an L.L.B. or J.D. degree
Licensed in good standing to practice law in Texas for a minimum of four yearsExperience in administrative, regulatory, or health law, or prosecutorial experience required
Experience with ISCs or administrative hearings, leadership, and reviewing documents preferred
KNOWLEDGE, SKILLS, AND ABILITIES
Knowledge of legal principles and practices of law related to the licensing and regulation of professional licensees, specifically licensees engaged in health care
Advanced Knowledge of applicable law and board rules regarding licensees of the agency
Knowledge of legal principles and practices of law related to development of cases for litigation and prosecution
Advanced Knowledge of Administrative Practice Act and Texas Rules of Civil Procedure
Knowledge of medical terms and definitions
Ability to interpret and apply laws
Ability to conduct hearings
Ability to conduct research and prepare cases
Ability to communicate effectively both orally and in writing
Ability to effectively manage multiple duties, set and meet deadlines
Ability to train and provide guidance to others

WORK ENVIRONMENT REQUIREMENTS

PHYSICAL REQUIREMENTS AND/OR WORKING CONDITIONS
The principal job is performed in a standard office or remote environment and requires:
All applicants must be available to work Monday-Friday during standard business hours in central time zone (CT), and must have regular and punctual attendance.

LEGAL REQUIREMENTS
Cannot hold outside employment that interferes with assigned work schedule, nor does it constitute a conflict of interest with TMB employment and services.
Must reside in Texas.

A DPS background check will be conducted.
