This National Guard position is for a ATTORNEY-ADVISER (GENERAL), Position Description Number D2250000 and is part of the 174TH ATKW, National Guard. This vacancy does not meet the criteria for appointment of annuitants. Responsibilities As an ATTORNEY-ADVISER (GENERAL) (GS-0905-12), you will serve as the sole full-time professional legal adviser, providing consultation, collaboration, support, guidance, and subject matter expertise (SME) to the Wing Commander. Also serves as the full-time legal adviser to Geographically Separated Unit (GSU) commanders and staff. Provides SME authoritative advisory, consultation, and collaboration in the areas of ethics, medical and physical evaluation, labor, domestic operations and administrative law. Requirements Conditions of Employment Qualifications Military Grades: OFFICER ONLY SPECIALIZED EXPERIENCE: Must have experience advising Commander and staff on interpretation of federal statutes and regulations, ensures that legal advice, consultation, and collaboration is furnished in a timely manner; advising senior leadership of the alternatives and possible solutions which are legally permissible or desirable; experience preparing, researching and issuing oral and written legal opinions and legal advice with regard to a wide variety of laws, regulations, instructions, directives and policies in the area of Administrative Law, including but not limited to: Freedom of Information Act, Privacy Act, reports of survey, line-of-duty determinations, constitutions and by-laws of private organizations, formal and informal investigations and commanders' inquiries, legal sufficiency reviews, collateral investigations, federal Uniform Code of Military Justice (UCMJ) and New York State Military Law (NYSML), Congressional Inquiries, Inspector General investigations, Equal Opportunity/Equal Employment Opportunity (EO/EEO) investigations, fiscal law, unfavorable personnel actions, standards of conduct, family advocacy, and public relations; experience providing advisory, guidance, consultation, and collaboration to Commander, staff, and supervisors; providing preventive law guidance to management personnel on the impact of regulatory changes. providing legal assistance on a non-interference basis to members of the ANG, spouses of members, and family members as authorized by ANGI 51-504, AFI 51-504 (when applicable), CNGBI, NGR, and other AF/JA guidance and, as resources and expertise permit, legal assistance may also be provided to Active Component members, other Reserve Component members, and retirees of any military service; experience formulating Wing legal policy and its execution; legal representation; legal initiatives; constitutional, civil, criminal, labor law; a full spectrum of expert legal advice to Wing leaders; providing professional legal advice and opinions on issues arising from federal laws and regulations and their application to the National Guard or concerning the federal mission of the National Guard, including homeland defense and security, emergency response, and application of state/territory compacts. Assignments involve extremely complex and difficult legal questions requiring extensive research, analysis, and evaluation of information in controversial scientific, financial, corporate, medical engineering, or other highly technical areas. Cases have an important impact on major private or public interests, such as cases concerning a major extension or revision in a grant program or a substantial question on civil rights. Interest in these cases is usually nationwide. Education GS-12 or equivalent entry-level attorneys are entrusted with the initial preparation of proposed solutions to projects. They conduct investigations to obtain facts, study legal precedents, make recommendations, and prepare necessary documents. They receive preliminary instructions, their commitment authority is limited, and their completed written work is carefully reviewed. Assignments require the first professional law degree (LL.B. or J.D.), active membership in the bar of the highest court of a State, Territory, or the District of Columbia, and one of the following: Two years of professional legal experience at or equivalent to the GS-11 level. OR The second professional law degree (LL.M.) plus one year of professional legal experience at or equivalent to the GS-11 level. To receive credit for Education, you must provide documentation of proof that you meet the Education requirements for this position. Recruitment, Relocation, or Retention Incentives (3R): A 3R incentive may be authorized for highly qualified applicants and/or for positions that are determined to be hard to fill. Approval Authority: The Adjutant General is the approval authority for requests up to 25% of the starting salary. The Office of Personnel Management (OPM) is the approval authority for requests up to 50% of the starting salary. If an incentive is requested, an official start date will not be established or provided to the selected candidate until final approval is received. Superior Qualifications Appointment (Advanced Step Placement): In accordance with agency pay-setting policy, the hiring official may request advanced step placement for highly qualified candidates of federal GS positions. Eligibility: To qualify, the candidate must be a newly-appointed General Schedule (GS) employee (defined as receiving their first appointment as a civilian employee of the Federal Government, or a former federal employee being reappointed after a break in service of at least 90 days). The hiring official must formally document and demonstrate that the candidate possesses: Superior Qualifications: The level, @type, or quality of the candidate's skills, competencies, accomplishments, education, or experience is significantly higher than what is minimally required for the position; OR Special Agency Need: The candidate possesses skills and competencies that are essential to accomplishing a critical, high-priority agency mission, goal, or program.
