Summary An independent Federal agency, the U.S. International Trade Commission provides the President and Congress with high quality analysis and technical support on international trade, tariff and competitiveness issues; hears and decides import injury cases and publishes the United States' tariff schedule. Responsibilities This position is located in the Office of the General Counsel (OGC). The incumbent of this position serves as an Assistant General Counsel providing technical legal expertise to the Commission in its unfair imports mission areas, specifically investigations involving intellectual property and unfair trade practices under section 337 of the Tariff Act of 1930 and litigation arising therefrom. This position supervises attorney-advisors working on such investigations, as well as litigation arising therefrom in the U.S. Court of Appeals for the Federal Circuit and other federal courts. As an Assistant General Counsel for unfair import investigations involving intellectual property and unfair trade practices under Section 337 of the Tariff Act of 1930, and related litigation the incumbent provides day-to-day supervision of attorney-advisors working on such investigations and litigation. As an Assistant General Counsel, you will review and approve drafts prepared by attorney advisors of memoranda, opinions, and other documents pertaining to Section 337 investigations, and review and approve drafts prepared by attorney advisors of briefs, memoranda, motions, orders and other documents related to Section 337 litigation before the U.S. Court of Appeals for the Federal Circuit and before other federal courts. Working with the General Counsel and other Assistant General Counsels, the incumbent performs supervisory functions including: updating training programs and conducting training of attorney-advisors; assisting in planning for Section 337 investigations and litigation; assisting in rulemaking proceedings; representing the OGC in interoffice meetings concerning Section 337 investigations; and overseeing attorney-advisor workload and assignment schedules. Requirements Conditions of Employment Qualifications Applicants must meet all of the qualification requirements, including education and any selective placement factors described below by the closing date of this announcement. Education must be accredited by an accrediting institution recognized by the U.S. Department of Education in order to be credited towards qualifications. Applicants must have the general and specialized experience outlined below which provided the applicant with the particular knowledge, skills and abilities to perform the duties of the position. To be hired as an Assistant General Counsel, you must: possess at least a Bachelor of Laws (LL.B) degree or a Juris Doctor (J.D.) degree from a law school accredited by the American Bar Association; AND currently be a member in good standing of the Bar of a state or territory of the United States, the District of Columbia, or the Commonwealth of Puerto Rico. In addition to meeting the basic qualification requirements above, applicants must have five years of specialized experience which is defined as professional legal experience in areas such as: appellate litigation; investigations under section 337 of the Tariff Act of 1930; judicial clerkship; federal administrative law; and/or experience interpreting statutes, regulations, court decisions and agency determinations OR one (1) year of general experience which is defined as professional legal experience of a broad, general nature, not requiring specialization or expertise in a specific area or @type of law AND four (4) years of specialized legal experience in the areas of investigations or litigation under section 337 of the Tariff Act of 1930 and/or supervising attorney advisors working on such investigations. This experience must have provided a thorough experience interpreting statutes, rules, regulations, court decisions and agency determinations related to the section 337 investigations. Applicant must have extensive experience writing and editing legal documents. Applicant must demonstrate supervisory level skills. Experience refers to paid and unpaid experience, including volunteer work done through national service programs (e.g., Peace Corps, AmeriCorps) and other organizations (e.g., professional; philanthropic; religious; spiritual; community, student, social). Volunteer work helps build critical competencies, knowledge, and skills, and can provide valuable training and experience that translates directly to paid employment. You will receive credit for all qualifying experience, including volunteer experience. Equivalent training is training permitted in some states in lieu of attendance at a law school.
