Compensation for this role: up to $160,000 Depending on Experience

Specific Responsibilities
Offer pragmatic, timely counsel on a variety of legal issues with an emphasis on contracts and compliance matters

Establish and maintain excellent rapport with internal and external customers and work collaboratively alongside colleagues in all areas of the company
Collaborate with the Director of Risk Management, other team members, and departments to find creative, practical solutions to legal challenges
Work diligently to complete projects that are assigned

Take ownership of, and responsibility for, projects that are assigned
Contract Review/Negotiation and General Legal Guidance
Review, modify and negotiate contracts with Encore's external customers and vendors with the assistance of the Contracts Administrator
Participate, and take a leading role, in Encore's internal contract review meetings
Educate key stakeholders and project teams regarding contractual risk and compliance requirements
Provide assistance with project disputes and risk mitigation
Assist with affirmative action audit, company licensing, corporate reporting and other legal initiatives
Contract Compliance
Review contract agreements, RFPs, and bid documents for all regulatory compliance, including Federal Acquisition Regulations (FARs), Code of Federal Regulations (CFR), United States Code (USC), and other federal, state, and local regulatory content to ensure company and project compliance
Review a wide variety of contracts for compliance issues. Provide project teams with a contract compliance review covering legal and regulatory requirements, job-specific requirements, provide a summary of notice provisions and change order processes, and other risk areas. Ensure compliance with all federal FAR and DFAR regulations
Complete all federal reporting requirements, including SF1413 form, Small Business Subcontracting Plan completion and reporting. Interface with the Prime Contractor to ensure compliance
Ensure compliance with M/WBE subcontracting requirements for publicly-funded projects:
o Develop and submit small-business subcontracting plans as required for federal projects of $1.5M or more. Work with project teams to identify qualified subcontractors and prepare and submit the small business subcontracting plan to the Prime Contractor and the federal government
o Provide project-team support with Denver M/WBE subcontracting requirements. Help project teams achieve good faith efforts to meet subcontracting goals by identifying qualified subcontractors and tracking solicitation efforts. Guide project teams in complying with Denver's ordinance and maintaining records and documentation
Legal Analysis and Research
Research and analyze complex legal/compliance issues and topics and prepare recommendations for courses of action
Maintain current knowledge of construction law and stay ahead of trends in the legal/regulatory environments and assess impact on the organization
Communicate changes in regulations to organizational leadership and other relevant departments and positions
Provide legal advice to departments, executives and project teams as requested
General Risk Management
Proactively identify, assess and mitigate risk in all areas of the organization
Participate in discussions and provide recommendations regarding risk management relating to potential future projects and strategies that the company is pursuing
Assist with risk assessments during project planning and execution
Initiatives and Training
Educate and train business units, the project managers, future leaders and others on a variety of issues related to contracts and compliance
Participate in a variety of strategic initiatives related to risk management
Other duties as may be assigned

REQUIREMENTS:
The position requires a law degree from an accredited law school, active membership in good standing with the State of Colorado bar, and 2-4 years of experience in a law firm or in-house legal setting. Candidates must demonstrate competency in contract negotiation and administration-preferably construction contracts-along with knowledge of Federal Acquisition Regulations and applicable state and federal statutes. Strong business acumen, ethical judgment, relationship management, critical evaluation, and effective communication skills are essential. Experience in the construction industry is preferred.
