Description of Job
This position manages aspects of litigation, to include discovery and manages the process for the intake, document retrieval, document review and record keeping of open record requests received by the Colorado Department of Corrections pursuant to the Colorado Open Records Act and Colorado Criminal Justice Records Act. Interacts with senior staff to distribute, analyze, and maintain documentation, as well as communicate issues, concerns, schedules, and expectations as it relates to open record requests. Position has the ability to work nearly completely independently, except for topics that necessarily require staffing with supervisor. Position provides support for other Offender Records. Position assists with some of the more advanced and complicated Open Records requests and will help supervisor with Subpoena Duces Tecum (SDT) and Subpoenas to include accepting service for these documents.
Job duties and responsibilities include but are not limited to:
Review all legal actions and administrative documents in which the department has been named as a defendant or is directly involved, with the exception of those relating to employee personnel matters;
Review, evaluate, and determine appropriate process the action will require;
determine if service has been properly perfected, provide notification to defendants, decide what motions must be filed, decide what reports must be prepared, determine investigations to be conducted, coordinate Court hearings and respond to interrogatories;
Prepare written and/or verbal responses to offenders, families, judges, attorneys and outside agencies regarding legal and administrative complaints, to defend
department's policies and procedures;
Determine proper application of Colorado Open Records Act (CORA), in order to maintain the Department's compliance with statutes;
Assists record requests and conduct initial review to determine appropriate routing based on the nature of the request;
Work with designated record custodian responders to ensure the request is understood and timelines are achievable;
Other duties/projects as assigned by supervisor.
Note: Occasional travel required to provide coverage for other CDOC Facilities throughout the state.

Minimum Qualifications:
Education/Licensure/Experience:
Paralegal certificate obtained through either an American Bar Association (ABA) approved paralegal studies program or an accredited institution. (Copies must be attached to your application to receive credit.)
Substitutions:
Two (2) years of work experience in a paralegal capacity which included conducting legal research, preparing drafts of legal documents and gathering and compiling data from legal references and resources will substitute for the required certificate. (This experience must be clearly described, in your own words, within the work experience section of your application to meet this requirement.)
Necessary Special Requirement:
Requires a p aralegal certificate to be obtained through either an American Bar Association (ABA) approved paralegal studies program or an accredited institution within 9 months of hiring.
A Juris Doctorate degree from an accredited law school may substitute for the required
certificate. (You must attach a copy of your unofficial transcripts with your name, college name, degree and date conferred in order to receive credit.)

The CDOC shall not hire nor promote anyone who may have contact with an offender who has engaged in sexual abuse which includes acts, activity, and sexual behavior, in a prison or other institution as defined in 42 U.S.C. 1997; or has been convicted of engaging or attempting to engage in sexual activity in the community facilitated by force, overt or implied threats of force or coercion, or if the victim did not consent or was unable to consent or refuse, or has been civilly or administratively adjudicated to have engaged in the activity described in the above paragraph. The agency shall consider any incidents of sexual harassment in determining whether to hire anyone who may have contact with offenders or residents.

Successfully pass all modules of the six-week Colorado Department of Corrections Basic Training, to include English reading comprehension, relevant competency assessments and written/practical exams in Defensive Tactics

Stabilize another person to accomplish a controlled take down
Use arms, palms of hands, shins, and feet to deliver blows
Withstand impact (slow speed or with a safety bag) on own body from strikes/blows

Rotate body 90 degrees with feet planted for striking with foot or using a defensive tactic;
Get down on one or both knees and up again with multiple repetitions
Will be exposed to Oleoresin Capsicum during Basic Training and will be exposed while on assignment

Successful completion of a background investigation is required. Should applicant's background reveal criminal charges, it shall be the responsibility of the applicant to provide the Department of Corrections with written/official disposition of any charges.
The CDOC is committed to a work environment free from illegal drugs and alcohol. A drug test will be administered to all new employees; employees must successfully pass. Random drug screening will occur throughout employment.
