Works under general supervision, with limited latitude for the use of initiative and independent judgment.Work Hours: Monday and#8211; Friday, 40 Hours a week, 8-hour DaysESSENTIAL JOB FUNCTIONS AND RESPONSIBILITIESProvide counsel and legal support primarily related to agency contracts and real estate transactions to agency management.
Advise on the interpretation, application and enforcement of agency laws and regulations.
Consult with and advises agency management on programs and issues involving legal risk.
Review laws, rules and regulations affecting agency operations and administration.
Provide legal advice on policy decisions, making and identifying appropriate legal solutions.
Provide updates on pertinent legal issues affecting the agency.
Provide input on development of agency programs and establishment of agency procedures.
Draft and review legal documents, bills, administrative rules and amendments for legislative consideration.
Draft, review or coordinate the drafting of contracts or other legal documents.
Review contracts and acquisition strategies for legal sufficiency.
Provide guidance to staff and management on various open government regulations and administrative rules.
Lead and conduct impartial investigations into formal employee complaints, including allegations of harassment, discrimination, retaliation, and other workplace misconduct, in accordance with agency policy and applicable laws.
Serve as a neutral fact finder, gathering and analyzing evidence through interviews, document reviews, and other investigative techniques to determine the validity of allegations.
Apply investigative frameworks such as Army Regulation 15-6 or equivalent standards to ensure procedural fairness and thoroughness.
Prepare detailed investigative reports and present findings, conclusions, and, when requested, recommendations to appropriate decision-makers.
Collaborate with HR and executive leadership to ensure timely resolution of complaints, typically within 30and#8211;60 calendar days depending on complexity.
Ensure compliance with anti-retaliation policies and advise on appropriate remedial or disciplinary actions when violations are substantiated.
Maintain confidentiality and integrity throughout the investigative process, ensuring all parties are treated with respect and due process.
Provide legal guidance on grievance procedures, informal resolution options, and policy interpretation related to employee conduct and ethics.
Support training and policy development initiatives to strengthen organizational awareness of employee rights, complaint procedures, and ethical standards.
Administer the agencyand#8217;s records and information management program and serves as the agencyand#8217;s centralized point of contact for the Texas State Library and Archives Commission.
Advise on record retention matters.
Represent TMD in unemployment insurance hearings and related proceedings, including preparation of case materials, coordination with HR staff, and presentation of agency position before the Texas Workforce Commission or other adjudicating bodies.
Attend various meetings on behalf of the agency.
Assist in the agency's strategic planning process. Perform analysis of complex factual and legal issues.
Assist in the representation of the agency with the Office of the Attorney General in civil and criminal actions brought by or against the agency.
Comply with all agency policies and procedures, including but not limited to applicable security and safety rules, regulations and standards.
