A glimpse of the job
The Deputy Director of Investigations, is responsible for ensuring that the University conducts prompt, thorough, and impartial investigations in accordance with Title IX, the Americans with Disabilities Act, Title V, Title VII of the Civil Rights Act of 1964, Texas state law and University policies after a formal complaint has been received. Manages a team of investigators and supervises all on-going investigations of discrimination, harassment, and related retaliation.
Essential Duties/Tasks
Investigation Unit Coordination and Supervision
Is responsible for the oversight and efficient functioning of the civil rights office's Investigations Division
Assigns investigators based on the complexity of the case and the workload of the investigator team
Prioritizes investigations based on the nature of the complaint, risk to health and safety of the university community, and any pending legal deadlines
Supervises investigators in developing investigation plans
Conducts regular meetings with investigators to clarify policy questions, trouble-shoot roadblocks, and monitor progress on active investigations
Ensures timely investigations and resolution of all reports of discrimination, sexual misconduct, sexual harassment, domestic violence, dating violence, and stalking, involving faculty, staff, students, or other members of the University/System community
Ensures that all investigations comply with the procedures, requirements, and time frames outlined in applicable regulations, rules, and standard administrative procedures
Reviews and edits all investigation reports, including exhibits, for bias, thoroughness, and compliance with university policy, federal regulations, and state law
Ensure that all allegations referred to investigation are addressed and that any conclusions are based on the application of law/policy to fact
Assist investigators in developing the consent construct for cases involving consent issues
Assist investigators with credibility assessments and preparation for testifying at administrative hearings
Balances a heavy workload with time constraints while managing and delegating tasks to other departmental employees
Consults with members of the Office of General Counsel (OGC) and the System, Ethics, and Compliance Office (SECO) to make sure all reports are legally sufficient. Assists investigators with any requested changes to the investigation report
Collaborates with the University's Office of Risk, Ethics, and Compliance (OREC) to ensure accuracy in reporting annual crime statistics, as required by the Jeanne Cleary Act
Drafts performance evaluations and provides feedback to all investigators
Civil Rights Investigations
Conducts complex investigations
Gathers evidence, interviews parties and witnesses, drafts investigation reports
Updates case logs
Provides timeline addendums, which are included in the Outcome Letter drafted by the hearing officer and/or appellate authority
Testifies on behalf of the department at civil and criminal court proceedings
Presents evidence and conclusions
Mitigates risk by documenting the University's actions in response to allegations of discrimination, harassment, or related retaliation
Maintains confidentiality to the extent allowed by federal regulations, state laws and university policies

Trains new investigators
Creates and updates investigator training materials in accordance with frequent changes to relevant laws/policies
Maintains knowledge and awareness of emerging topics in civil rights
Represents the department at special events, community functions, and University trainings

Required Education and Experience
Bachelor's degree or equivalent education and experience
Seven years of investigation experience, which includes experience conducting investigations, writing/editing reports, and participating in hearings
Preferred Qualifications
Experience in living hearings related to alleged Civil Rights or Title IX violations for a college or university with at least 35,000 students
Supervisory experience over employees who conduct investigations of alleged Civil Rights, Title IX, Employee Relations, or FMLA/ADA violations, conduct alleged fraudulent insurance claims, child protective services, participate in civil or criminal trials as an attorney or expert witness, conduct law enforcement/social service investigations related to family violence, abuse, or neglect of minor/elderly, sexual assault, dating/domestic violence, or other felony charges, draft complex policies, procedures, or reports related to compliance or corporate/university governance

Ability to maintain the confidentiality of private or sensitive information
Ability to obtain professional certifications related to Title IX and civil rights
Proficiency in Microsoft applications with an emphasis on Word, Excel, Outlook, and PowerPoint
