Duties Description The incumbent will report to the Office of Emergency Management (OEM) Legal Unit. Duties include, but are not limited to:- Serve as legal counsel for the OEM.- Provide technical legal assistance and advice to the OEM Director, executives, and staff related to preparedness and response.- Provide legal advice and guidance to staff on matters related Access and Functional Needs (AFN).- Interpret laws applicable to OEM programs.- Consult with the program regarding new legislation and changes in existing laws, rules, and regulations.- Develop, review, and recommend to the General Counsel and OEM changes to existing legislation; recommend the creation of new statues, rules, regulations and/or policies.- Render advice and legal opinions concerning all programs administered by OEM.- Advise program on compliance with all applicable laws, rules and regulations, to include the Americans with Disabilities Act, the Rehabilitation Act of 1973, NYS Human Rights Law, and other related federal, State, local laws and regulations pertaining to accommodating people with disabilities and others with functional and access needs (DAFN).- Develop or modify, and deliver legal training programs for local chief executives, emergency managers, and others as necessary.- Coordinate with Deputy Counsel to prepare legal documents related to disasters, emergencies and other incidents, to include State Disaster Emergency declarations.- Provide programmatic review of OEM agreements, such as, contracts, memoranda of understanding, and letters of agreement.- Provide legal advice and guidance to assist and guide the State in responding and recovering from disaster emergencies.- Advise counsel and program on FOIL requests and Ethics inquiries and outside employment requests as necessary. - Ability to work in a team/collaborative environment and on a 24/7 basis when required.- Strong/effective communication skills to advise/inform State executives on legal issues/options in responding to a disaster emergency.- Perform other duties as assigned.- Travel may be required, up to 15%.
Minimum Qualifications This title is part of the New York Hiring for Emergency Limited Placement Statewide Program (NY HELPS).To be considered for appointment through NY HELPS, or 55 b/c, candidates must meet the open-competitive minimum qualifications for this position. This title includes a traineeship opportunity and applicants will be appointed to the appropriate level based on their experience and education.*Senior Attorney level requirements:-Assistant Attorney 1 (equated to SG-18): Law School Graduation (or other eligibility to take the NYS Bar Examination)- Assistant Attorney 2 (equated to SG-20): Admission to NYS Bar - Assistant Attorney 3 (equated to SG-22): One year as Assistant Attorney 2 or admission to the NYS Bar and one year of post-licensure professional legal experience.- Senior Attorney: Admission to the NYS bar and two years of post-licensure professional legal experience.Advancement Within the Legal Traineeship: If you are appointed to one of the entry levels (Assistant Attorney) of the Attorney Traineeship, you will normally be advanced after each twelve months of satisfactory service to the next higher title (with salary based on performance) until you reach the full performance level of a Senior Attorney.If you are appointed as an Assistant Attorney 1, you will be automatically advanced to Assistant Attorney 2 upon admission to the New York State Bar. If you are not admitted to the New York State Bar within two years of appointment, your appointment will be terminated.ORCurrent New York State employee with one year or more of permanent, contingent-permanent, or 55b/c service and eligible for transfer under Section 70.1 or 52.6 of Civil Service Law. 52.6 transfers must meet the special qualifications of: admission to the NYS Bar and 24 months of subsequent satisfactory legal experience.Preferred qualifications: - Experience with equal opportunity, civil rights, minority business development, or similar programs.- Working knowledge of the Americans with Disabilities Act, the Rehabilitation Act of 1973, Civil Rights Act of 1964, NYS Human Rights Law, and other related federal, State, local laws and regulations pertaining to accommodating people with disabilities and others with functional and access needs (DAFN).
Additional Comments ***This title is part of the New York Hiring for Emergency Limited Placement Statewide Program (NY HELPS). For the duration of the NY HELPS Program, this title may be filled via a non-competitive appointment, which means no examination is required but all candidates must meet the minimum qualifications of the title for which they apply. At a future date, it is expected employees hired under NY HELPS will have their non-competitive employment status converted to competitive status, without having to compete in an examination. Employees will then be afforded with all of the same rights and privileges of competitive class employees of New York State. While serving permanently in an NY HELPS title, employees may take part in any promotion examination for which they are qualified.NOTE: Support of operations during times of emergency and disaster from State Emergency Operations Center (EOC), state field offices and/or local deployments may be required, which would result in a change and/or increase in working hours, locations and/or duties.NOTE ON TELECOMMUTING: Employees are required to apply and obtain approval through management to telecommute according to the agency's Telecommuting Program Guidelines.Please note that your continued employment is dependent upon your sustained registration to practice law in New York State.
