Duties Description When assigned to the Administrative Adjudication Unit (AAU) under the direction of an Associate Attorney, the Hearing Officer 1 is responsible for holding fair and impartial hearings on behalf of the Commissioner of Labor. These hearings involve multiple areas of Labor Law, including settlement conferences involving alleged violations of worker protection laws. The incumbent should be able to perform the following, but not limited to:- Ensure that administrative hearings and appeals are conducted in compliance with applicable laws and regulations while maintaining fairness and efficiency throughout the process- Serve as an impartial party, evaluate evidence, administer oaths, and elicit testimonies from parties and witnesses- Issue subpoenas, manage hearing calendars, rules on motions, objections, and the admissibility of evidence- Prepare written reports, opinions, and decisions, recommend acceptance or rejection of claims, and provide guidance on appeals- Review new laws, regulations, and court cases that affect hearings and assist in defending lawsuits related to hearing decisions - Conduct mediation and compliance conferences for settlement purposesWe offer telecommuting and alternative work schedules to eligible employees. Eligible employees may be approved to telecommute, if operationally feasible, up to 2 days per regular work-week, and not to exceed 4 days per two-week pay period. Minimum Qualifications NY-HELPS NON-COMPETITIVE MINIMUM QUALIFICATIONS:Qualifications for Assistant Attorney 2:Admission to NYS BarQualifications for Assistant Hearing Officer:12 months as an Assistant Attorney 2, or Admission to the NYS Bar and 12 months of subsequent satisfactory legal experience in the trial of issues in courts of record or in the conduct or trial of adversary proceedings, quasi-judicial in nature, before a governmental department or agencyQualifications for Hearing Officer 1:Admission to the NYS Bar and 24 months of subsequent satisfactory legal experience in the trial of issues in courts of record or in the conduct or trial of adversary proceedings, quasi-judicial in nature, before a governmental department or agency.It is expected that employees hired under NY HELPS will have their non-competitive employment status converted to competitive status in the future, without having to compete in an examination. Employees will then be afforded all of the same rights and privileges of competitive class employees of New York State.
