Job Description

Duties and responsibilities include performing professional legal services in support of the County Attorney's Office. Collaborate and support justice agencies and county departments in completing the duties of the Office. Responsible for providing legal advice, opinions and representing the County in civil court cases. Prosecution of adult and juvenile criminal matters. Responsibilities may include meeting with witnesses and victims; drafting legal documents including research and writing; preparing cases for court hearings and trials; providing legal advice to various County staff; representing the County in court; handling appeals; other duties as required by statute and law; and other duties as assigned.

Job Responsibilities

ESSENTIAL DUTIES: (These duties are a representative sample; position assignments may vary.)

Drafts pleadings for criminal prosecutions and prepares and prosecutes felonies, gross misdemeanors and, to the extent prescribed by law, violation of misdemeanors and municipal ordinances and rules. Reviews police reports and evidence to determine proper charging; prepares criminal complaints and other legal documentation; prepares for and appears at pretrial and trial.

Consults, advises, and represents the County in juvenile delinquency matters.

Consults, advises, and represents the County in CHIPS (Children in Need of Protection or Services) and/or termination of parental rights petitions; provides legal guidance with regard to maltreatment and abuse determinations to child protection team and staff.

Provides child support enforcement and paternity adjudication services to child support unit. Reviews information from public health and human services; prepares pleadings and other legal documentation; prepares for and appears at court hearings; provides legal advice to county staff; conducts legal research, as necessary.

Consults with, conducts legal research on and provides legal opinions to other County departments, including for issues involving Meeker County Ordinances.

Each of the above functions require comprehensive knowledge of complex legal principles and practices, including continuing research and expansion of knowledge pertaining to principles of criminal and civil law as well as their application with emphasis on enforcement procedures sufficient to gather evidence and advise County Departments on relevant concerns and changes in the laws.

Performs other duties of a similar nature or level.

Assistant County Attorney I shall be responsible for the following duties:

· Prosecutes all levels of criminal offenses; reviews police reports and evidence to determine proper charging; prepares criminal complaints and other legal documentation such as pleadings, jury instructions, proposed orders and formal briefs.

· Prepares for and appears at bail hearings, pretrial, trial, post-trial, and appellate court proceedings. Researches issues to provide legal advice to law enforcement officers and county departments with consultation with Attorney II/County Attorney.

· Performs legal research and prepares memoranda of law and briefs in pending cases.

· Handles civil matters, including child support enforcement and paternity adjudication services, guardianship/conservatorships, commitments, child protection, adult mental health and protection, voter registration issues, gun permits, land use, and other matters as assigned.

Assistant County Attorney II shall be responsible for the following duties:

· In addition to all duties as described above, provides legal advice and assistance to other County departments related to statutes, rules, ordinances, regulations and other legal matters including legal correspondence without direct supervision; conducts legal research and attends meetings as assigned.

· Mentors and trains new attorneys and staff, including co-chairing trials and providing staff with additional training resources and expertise.

· Other matters as assigned.

Education and/or Experience

TRAINING AND EXPERIENCE REQUIREMENTS:

Juris Doctorate degree and sufficient experience necessitated by the competency level of the position.

Assistant County Attorney I - 0 to 4 years of practical experience as an attorney.

Assistant County Attorney II - At least 4 years of practical experience as an attorney.

LICENSING REQUIREMENTS:

Assistant County Attorney I - Ability to become licensed in the State of Minnesota within 1 year.

Assistant County Attorney II - Minnesota Law License.

KNOWLEDGE REQUIREMENTS:

PHYSICAL REQUIREMENTS:

Positions in this class typically require reaching, standing, walking, fingering, grasping, feeling, talking, hearing, seeing and repetitive motions.

Sedentary Work: Exerting up to 10 pounds of force occasionally and/or a negligible amount of force frequently or constantly to lift, carry, push, pull or otherwise move objects, including the human body. Sedentary work involves sitting most of the time. Walking and standing are required only occasionally.

2026 Salary Information: Compensation Grade Level & Pay Range based on experience.

GRADE LEVEL: Assistant County Attorney I - P ay Range: $85,030.40 - $95,680.00

GRADE LEVEL: Assistant County Attorney II - Pay Range: $98,592.00 - $132,412.80
