About the Organization: The Division of Standards (DOS), an Agency within the Office of Consumer Affairs and Business Regulation (OCABR), is responsible for enforcing the accuracy requirements and other standards relating to commercial weighing and measuring devices and their use in the sale of food, fuels and other products. It regulates the sale of gasoline and sets standards for lubricating oils and antifreeze, including the inspection of all fuel dispensing equipment. It determines the standards for accuracy of clinical glass thermometers, tests and approves coin operated devices, licenses auctioneers, promoters, transient vendors, peddlers, motor fuel and oil retailers and registers auto damage repair shops. The Division also enforces the item pricing law and the unit pricing regulations, issues waivers to retail food and grocery stores and enforces the scanner accuracy requirements in all retail stores. The Division is also responsible for enforcing licensing requirements for over ten thousand licensees. About the Role: The Associate Deputy Commissioner for Field Services and Operations (the "ADC") is responsible for the general oversight of the Division of Standards' compliance officers and supervisors ("CO"s) and of municipal sealers ("Sealers") (together, "Inspectors") including program management and support, goal setting, performance monitoring, and creation of assignment priorities. The ADC, working under the supervision of the Commissioner and the Deputy Commissioner/General Counsel, is responsible for developing and implementing curriculum and training programs for Inspectors consistent with applicable Massachusetts law and regulations and industry best practices. The ADC is responsible for developing testing methods and instruments used to certify Inspectors both for qualification and for additional disciplines, supporting the efforts of the DOS Standing Advisory Committee to establish certification standards for Inspectors, and providing general oversight over Inspectors' conformance with certification standards, best practices, and applicable laws and regulations, including the National Institute of Standards and Technology's ("NIST") Handbooks 44, 130, and 133. Additionally, the ADC makes recommendations to Division leadership for the improvement of training and continuing education programs and works with Division leadership and staff on the collation of information necessary for the Division's annual report. The ADC may be called on to participate in national "train the trainer" programs offered by the NIST Office of Weights and Measures in order to further develop training and education opportunities for Inspectors. The ADC is additionally responsible for developing and recommending policies designed to improve service delivery, subject to the review and approval of the Commissioner and/or Deputy Commissioner/General Counsel and will assist in the development and formulation of regulations required to be promulgated by the Division. The ADC is responsible for developing and implementing data collection, management, storage, and retrieval guidelines consistent with industry best practices, for inspection reports and related data, as well as for citations and fines issued by the Division in response to violation of the laws the Division enforces. The ADC is additionally responsible, under the general supervision of Division leadership, for the operational management of equipment, vehicles, and other tools used in the performance of inspections and field compliance activities. Duties and Responsibilities: Responsible for leading and supervising the training and education of Inspectors. Develop and implement weights and measures training programs consistent with industry best practices and established national standards. Develop testing instruments used to certify Inspectors both for certification and for qualification for additional disciplines including but not limited to the duties and responsibilities of Inspectors, unit pricing, item pricing, price verification, package and label checking, taximeters, vehicle tank meters (VTMs), liquid propane delivery systems, electric vehicle supply equipment (EVSE), scales with capacity greater than 100 pounds, and compliance with the Motor Fuels Sales Act. Formulate, develop, and implement Division polices, standard operating procedures (SOPs), job aids, and other reference materials used in the performance of weights and measures inspections and investigations; additionally assist and advise on the use and usability of software solutions utilized by the Division. Support the efforts of the DOS Standing Advisory Committee to establish certification standards and promulgate regulations under the Merchant and Consumer Protection Act. Review and develop practical and written examinations used in the certification of Inspectors and make recommendations to Division leadership for the improvement of training and continuing education programs. Operational management of equipment, vehicles, and other tools used in the performance of inspections and field compliance activities. Lead the development and revision of Division policies and regulations. Identify policy and regulatory needs and develop recommendations to ensure consistency with applicable Massachusetts laws, regulatory requirements, industry standards and Division objectives. Other duties, as assigned, such as maintaining electronic and physical records, preparing correspondence, conducting data entry into Agency databases, and attending meetings or professional trainings, as requested by the Commissioner or Deputy Commissioner/General Counsel. Assist Division personnel and other interested parties with technical assistance and advice concerning assigned programs in order to exchange information, resolve problems and ensure compliance with established policies, procedures and standards. Respond to inquiries from Agency staff and others in order to provide information concerning assigned agency programs. Review data and team performance to develop and implement standards to be used in program monitoring and/or evaluation. Retrieve, review, and present inspection and related data as requested by the Commissioner or Deputy Commissioner/General Counsel. Attend trainings, seminars, meetings, and symposia as required by the Commissioner. Preferred Knowledge, Skills, and Abilities: Experience in the practice, investigation, and/or enforcement of Massachusetts weights and measures laws. Demonstrated experience in the training, evaluation, and/or mentoring of weights and measures or inspection professionals. Ability to effectively manage field staff, set goals for performance, and exercise independent judgment and strategic thinking in the performance of duty. Ability to develop learning and training materials for use by diverse audiences and constituencies. Data management and presentation skills. Excellent written communication skills. Ability to travel and work throughout the Commonwealth. Ability to exercise sound judgment. Ability to be professional and communicate effectively with others. Ability to handle highly sensitive and confidential information with discretion. Demonstrated ability to work independently and meet deadlines. Ability to perform other duties or responsibilities, outside of assigned day-to-day responsibilities, based on the operational needs of the Agency. Ability to adapt to new technologies: Software and Hardware (training provided). Experience managing a similarly sized team of professionals working in a field inspection environment. Knowledge of the laws, rules, regulations, policies, procedures, specifications, standards and guidelines around compliance. Knowledge of investigative techniques.
