Duties Description The Regulatory and Policy Unit Manager serves as the Division of State Emergency Medical Services' lead analyst for EMS, trauma, and disaster health regulation, policy, guidance, and legislative matters. The position develops and advances regulations in accordance with Public Health Law, the State Administrative Procedure Act, Department rulemaking procedures, and other applicable requirements; conducts health planning, policy, and legislative analyses; develops policy and guidance documents that provide operational detail, interpretation, and instructions not typically contained in statute or regulation; evaluates statewide system needs and performance; and prepares evidence-based recommendations for Division and Department leadership.The incumbent leads the day-to-day operations of the Regulatory and Policy Unit and coordinates work with Division programs, Department legal counsel, regulatory affairs staff, legislative affairs staff, other governmental entities, regulated organizations, professional associations, and external stakeholders. The position ensures that regulations, policy and guidance documents, legislative analyses, and related materials are legally consistent, analytically sound, operationally feasible, clearly written, and aligned with Division priorities and statewide EMS system needs.The position performs advanced regulatory, policy, legislative, and health-planning work involving complex and frequently evolving issues affecting New York State's EMS, trauma, and disaster health systems. Assignments may involve broadly defined concerns, incomplete or conflicting information, differing stakeholder perspectives, and changes in law, regulation, policy, technology, workforce conditions, health care delivery, or system performance. The incumbent independently interprets and applies Public Health Law, the State Administrative Procedure Act, existing regulations, Department policies, legal guidance, administrative precedents, health-planning principles, research findings, and State and national standards to determine whether an issue should be addressed through statutory change, formal rulemaking, policy or guidance, or another administrative action.The incumbent develops policy and guidance documents that translate broad statutory or regulatory requirements into clear operational instructions, procedures, expectations, and implementation standards without exceeding legal authority or creating unintended requirements. The work requires analysis of legal, operational, fiscal, workforce, demographic, geographic, equity, and public-health implications; Reconciliation of differing interpretations and recommendations; And substantial judgment in developing recommendations, evaluating public comments and legislative proposals, resolving inconsistencies, and determining whether work products are complete and sufficiently supported for legal, executive, or Department review. Major Functions & Associated Duties: Regulatory Development and RulemakingDevelops and advances EMS, trauma, and disaster health regulations in accordance with Public Health Law, the State Administrative Procedure Act, Department rulemaking procedures, and other applicable legal and administrative requirements; Identifies regulatory needs through review of statutory changes, existing requirements, Division operations, compliance findings, stakeholder concerns, emerging practices, and State and national standards; Researches statutory authority, legal interpretations, administrative precedents, policy literature, and regulatory approaches used by other jurisdictions to define available options and constraints; Develops regulatory concepts and drafts proposed regulatory language in consultation with Department legal counsel, Division subject-matter experts, and affected programs; Prepares statements of purpose, regulatory impact statements, flexibility analyses, notices, assessments of public comment, and other rulemaking documents required by the State Administrative Procedure Act and Department procedures; Coordinates internal, legal, fiscal, regulatory affairs, and executive review of proposed regulations and maintains schedules and trackers for required approvals, notices, public-comment periods, and filing deadlines; Organizes stakeholder consultations and technical discussions to evaluate the legal, clinical, operational, fiscal, workforce, geographic, and public-health effects of proposed requirements; Analyzes public comments, conflicting recommendations, implementation barriers, and unintended consequences and prepares responsiveness summaries, issue papers, and decision memoranda recommending revisions or final action; Coordinates final revisions and filing materials and tracks regulatory proposals through publication, public comment, adoption, and implementation.Health Policy Analysis and Strategic PlanningConducts health planning and policy analyses to identify statewide EMS system needs, evaluate performance, and develop evidence-based recommendations for Division and Department leadership; Researches emerging trends, national standards, professional guidance, academic literature, governmental reports, legislative proposals, and practices used by other states; Analyzes demographic, geographic, operational, workforce, utilization, quality, financial, and system-performance information to identify service gaps, emerging risks, resource needs, and opportunities for improvement; Compares EMS, trauma, and disaster health system performance against statutory objectives, Department priorities, State and national benchmarks, professional standards, and established program outcomes; Conducts needs assessments and planning studies and develops appropriate research questions, analytical frameworks, evaluation criteria, data requirements, and methodologies; Reviews quantitative and qualitative information from Division programs, statewide data systems, regulated entities, professional organizations, research institutions, federal agencies, and other states and identifies limitations, inconsistencies, assumptions, and information gaps; Evaluates the legal, operational, fiscal, workforce, demographic, geographic, equity, and public-health effects of proposed statutes, regulations, policies, programs, and system changes; Develops and compares policy alternatives based on statutory authority, available evidence, anticipated outcomes, implementation feasibility, resource requirements, stakeholder effects, and risk; Prepares issue papers, needs assessments, planning reports, statistical and narrative analyses, executive briefings, presentations, and decision memoranda and recommends policy, regulatory, statutory, programmatic, or administrative action; Develops performance measures and follow-up analyses to evaluate outcomes and contributes to Division strategic planning by identifying emerging issues, long-term needs, and regulatory priorities.Policy Development, Implementation, and Lifecycle ManagementDevelops and maintains Division policies, guidance documents, interpretive statements, and implementation resources that translate statutory and regulatory requirements into clear and consistent operational expectations; Drafts and revises policies, administrative directives, technical advisories, implementation memoranda, frequently asked questions, compliance tools, and related materials; Determines the appropriate policy instrument based on statutory authority, legal effect, intended audience, compliance expectations, enforcement implications, and Department approval requirements; Leads cross-unit workgroups and coordinates review with legal counsel, Division leadership, subject-matter experts, communications staff, information-technology staff, and other affected offices; Analyzes and reconciles conflicting interpretations, recommendations, and operational concerns and reviews proposed materials for legal consistency, factual accuracy, clarity, feasibility, enforceability, and alignment with Division objectives; Develops implementation requirements addressing affected organizations, required actions, compliance dates, communications, training, system changes, technical assistance, and monitoring activities; Prepares transmittals, implementation memoranda, executive briefings, stakeholder communications, and educational materials and coordinates issuance and implementation with responsible programs; Evaluates implementation questions, barriers, inconsistent interpretations, and stakeholder concerns and recommends clarification, technical assistance, corrective action, or policy revision; Maintains a centralized inventory and revision history for regulations, policies, guidance, and interpretive materials and conducts periodic reviews to revise, consolidate, replace, or rescind outdated documents; Preserves approved versions, supporting analyses, legal comments, public-comment records, implementation materials, and final issuance documentation.Legislative Analysis and Stakeholder CoordinationAnalyzes proposed legislation and coordinates consultation with governmental, professional, and regulated stakeholders to inform Division policy positions and recommendations; Monitors introduced legislation, executive proposals, statutory amendments, and legislative concepts affecting EMS, trauma systems, disaster health services, regulated entities, practitioners, or Division operations; Reviews proposed legislation in relation to existing statutes, regulations, policies, programs, organizational authority, funding, staffing, data systems, compliance activities, and affected stakeholders; Evaluates legal, fiscal, operational, workforce, administrative, and public-health impacts in consultation with Division programs, Department legal counsel, fiscal staff, legislative affairs staff, and other affected offices; Prepares legislative analyses, bill comments, impact summaries, executive briefing materials, recommended amendments, and proposed Division positions; Develops legislative concepts and statutory amendments to address policy gaps, modernize legal authority, support Division initiatives, or improve EMS system performance; Organizes and leads informational meetings, stakeholder consultations, and policy discussions with State agencies, regional organizations, EMS councils, regulated entities, professional associations, health care providers, educational institutions, researchers, and other interested parties; Evaluates stakeholder concerns and recommendations and documents unresolved issues requiring further analysis or leadership decision; Presents policy analyses, regulatory proposals, legislative impacts, and Division recommendations and represents the Division on committees, interagency groups, professional workgroups, and other forums.Unit Leadership, Supervision, and Quality AssuranceDirects the day-to-day operations of the Regulatory and Policy Unit and establishes work practices that support timely, accurate, consistent, and analytically sound products; Develops unit work plans and establishes priorities, schedules, assignments, review requirements, and expected work products based on legal deadlines, program needs, staff capacity, and assignment complexity; Assigns work according to staff knowledge, experience, workload, and developmental needs and adjusts assignments to address emerging priorities, absences, or delays; Provides technical direction concerning health planning, policy analysis, regulatory drafting, legislative analysis, research methods, stakeholder consultation, and Department review procedures; Reviews regulations, policies, reports, analyses, correspondence, presentations, and briefing materials for factual accuracy, analytical sufficiency, legal and programmatic consistency, clarity, completeness, and conformity with Department standards; Directs additional research, consultation, analysis, revision, or quality-control review when work products do not meet established requirements; Trains and coaches staff, evaluates performance, provides feedback, identifies professional-development needs, and addresses work-performance or quality concerns; Participates in recruitment, selection, onboarding, and training of unit staff; Develops and maintains templates, drafting conventions, style standards, review checklists, regulatory trackers, policy inventories, records-management procedures, and version-control practices; Reports unit accomplishments, work status, emerging issues, resource needs, risks, and recommended actions to Branch and Division leadership and recommends changes to improve efficiency, timeliness, consistency, analytical quality, and document control.
Minimum Qualifications Permanent Transfer Candidates: Current NYS Department of Health employee with one year of permanent or contingent-permanent competitive service as an Associate Health Planner, SG23 OR current DOH employee with one year of permanent or contingent-permanent competitive service in a title SG21 or higher and eligible to transfer under Section 52.6 of the NYS Civil Service law.Non-Competitive Candidates via NY HELPS: Seven years of experience where your primary duty was performing two of the five activities below:Health services research and analysis of health care systems resources, beds, services allocations, or processes of care.Demographic or economic analysis for projecting need for health care facilities and services.Analysis of health care resources, staffing needs, usage patterns, health services quality, or patterns of clinical care.Health care policy development and analysis on a statewide, regional, or county basis.Preparation or review of CON applications in a State regulated health care facility or governmental agency.Substitution: An associate degree may substitute for two (2) years of experience; a bachelor's degree may substitute for four (4) years of experience; a master's degree may substitute for five (5) years of experience; and a doctorate may substitute for six (6) years of experience.Preferred Qualifications: Preferred Qualification (Certifications / Licenses): Formal training or certification in public policy, regulatory affairs, health planning, legislative analysis, program evaluation, public health, health care administration, or a related field preferred.Preferred Qualifications (Experience): Experience developing, interpreting, or implementing regulations, policies, standards, or guidance documents in government, health care, consulting, nonprofit, professional associations, or another regulated environment; Experience drafting policy documents, regulatory language, legislative analyses, reports, executive briefings, or formal recommendations; Experience conducting health-planning, policy, program, or system-performance analyses; Experience coordinating work with legal counsel, subject-matter experts, regulated organizations, governmental entities, or other stakeholders; Experience supervising staff or leading professional workgroups preferred; Experience in EMS, trauma systems, disaster health services, public safety, health care regulation, or a related field preferred.Preferred Qualifications (Knowledge / Skills / Abilities): Knowledge of health planning, policy analysis, legislative analysis, regulatory development, administrative rulemaking, and program evaluation; Ability to interpret statutes, regulations, policies, guidance, legal opinions, and technical standards; Ability to research complex issues, evaluate qualitative and quantitative information, compare alternatives, and develop supportable recommendations; Ability to draft clear regulations, policies, guidance documents, analyses, reports, and executive materials; Ability to evaluate legal, operational, fiscal, workforce, and public-health impacts; Ability to reconcile differing perspectives and communicate complex information clearly; Ability to manage competing priorities, meet deadlines, supervise staff, and review professional work products for accuracy, clarity, and consistency.
Additional Comments Health Emergency Management Statement: All Division of State Emergency Medical Services staff are expected to participate in emergency management activities as part of their roles. While not all positions require regular deployment to disaster sites, all employees may be subject to 24/7 recall for emergency operations. This may involve irregular work hours, duties outside of the official position description, and assignments at locations other than the designated duty station.
