Position Summary Within MassDOT, the Registry of Motor Vehicles (RMV) administers a variety of licensing and registration functions and services. Reporting to the RMV Chief Compliance Officer, the Administrative Review Officer III is responsible for scheduling and holding administrative hearings and issuing written hearing notices and determinations. Hearing matters include but are not limited to alleged violations and misconduct by licensed vehicle inspectors and inspection stations, Professional Driving Instructors, Professional Driving Schools, Certified School Bus drivers, School Pupil Transport Vehicle drivers, General Registration holders (aka Section 5 registrations) , Electronic Vehicle Registration (EVR) permit holders, International Registration Plan (IRP) registrants, as well as alleged violations that would require motor vehicle title and registration suspensions or revocations. Duties and Responsibilities Ensure hearings are held in compliance with the requirements of 540 CMR 9.00 including but not limited to rendering a written hearing decision within 10 days of the conclusion of the hearing. Responds to RMV business unit requests for hearings according to established time frame. Review all relevant information and documentation compiled by the business area prior to scheduling a hearing and independently request and gather additional materials and information from the business areas and external entities (including but not limited to employers, courts, or law enforcement). Serve as an internal and external resource to research and resolve alleged violations of law, policy, and misconduct. Work with business areas to research and determine if a hearing is warranted. Handles interactions with customers, RMV colleagues, and other parties engaged with the RMV in a professional, efficient, and courteous manner in all verbal and written communication. Prepares and issues written hearing notices and hearing decisions to the customer within required time frames and in adherence to RMV standards. Conduct administrative hearings by reviewing documentation, interviewing witnesses, and rendering objective decisions based on the relevant facts, applicable laws and regulations, and agency policies and procedures, to ensure consistent agency adherence to legal requirements. Prepare reports, as needed, identifying case strengths and weaknesses, prior action taken in substantially similar matters, and recommended findings. Communicate decisions to the business area, the CCO, and to RMV Legal Counsel as needed, in adherence with established timeframes and RMV policies and standard operating procedures. Develops and maintains a thorough understanding relevant federal and state laws and regulations, and RMV policies and procedures. Ensure consistency and compliance in applying all relevant laws, regulations, and RMV policies and procedures in issuing decisions and any adverse actions. Maintains current, accurate, and organized records of all hearing requests, notices, and decisions. Provide training, direction, and supervisory support to Hearing Officers and any other staff as determined by the CCO. Develop training materials and evaluate/monitor progress in the conduct of administrative hearings. Ensure that issued adverse action, inclusive of suspensions, revocations, and fines are applied to the customer's record and communicated as necessary. Develop and maintain a clear understanding of federal, state and RMV data privacy requirements and adhere strictly to those requirements. Manage scheduling of hearings (in person and virtual) and monitor timeline to ensure hearings are completed in a reasonable timeframe and in accordance with 540 CMR 9.00. Provide information and status updates regarding specific hearings upon request of the CCO. Perform other additional and compliance related work as assigned by the CCO. Prepare, deliver, and defend the RMV in administrative grievance hearings and procedures before the Board of Appeals as necessary.
