The Senior Attorney, Marketing and Advertising, will provide counsel to the Company's business teams on compliance matters related to marketing, advertising, store operations, and consumer engagement. Areas of subject matter expertise include laws and regulations (1) prohibiting false and deceptive trade practices (including, but not limited to, related to matters concerning consumer facing messaging, price promotions, and influencer compliance) and (2) governing sweepstakes, gift cards, languages, online accessibility, and other areas of consumer engagement, as well as associated commercial contracting and risk assessments. This individual will collaborate across multiple business functions to support operational and strategic goals.
Responsibilities:
Provide legal guidance and consultation to ensure marketing and advertising compliance with applicable Federal Trade Commission laws and regulations and similar state laws and regulations and to negotiate commercial contracts regarding the same. Key responsibilities and areas of focus include, but are not limited to:
Advise on price promotions requirements.
Provide counsel on consumer facing promotional messaging.
Draft compliance materials associated with sweepstakes and promotions.
Draft and negotiate commercial contracts for marketing and advertising services and for engagement of influencers.
Develop and assist with implementation of compliance programs (including, but not limited to, regarding disclosure of material connections in alignment with requirements of the Federal Trade Commission).
Advise on compliance with respect to gift cards, languages, online accessibility, return policies, rewards program terms and other terms of use.
Collaborate with cross-functional stakeholders to anticipate and respond to changes in the compliance landscape and develop solutions to mitigate risk.
Address potential issues related to marketing and advertising compliance.
Analyze complex legal and business issues and communicate risk assessments and legal advice clearly and concisely.
Evaluate the effectiveness of compliance processes, programs, and technologies.
Provide legal input on policy development and training initiatives.
Manage and engage outside counsel as needed.
Qualifications
Juris Doctor (JD) from an accredited law school.
Minimum of 7 years of experience in marketing and advertising compliance, preferably with a combination of law firm and in-house counsel roles.
Strong organizational skills and ability to manage a high volume of work.
Excellent communication and relationship-building skills; proven ability to collaborate effectively with cross-functional teams.
Demonstrated ability to take independent, decisive action while managing multiple priorities.
Commitment to conducting work in an ethical, professional, and confidential manner.
