Duties Description The incumbent of this Legal Assistant 2 position provides litigation support for the Judgment Enforcement Team (JET), a new unit within the Civil Recoveries Bureau responsible for large-dollar, complex, and high-profile judgment enforcement, and performs the following duties:- Oversee and/or perform the process of opening or closing files and cases within unit.- Review investigation or litigation-related materials.- Search for and gather information pertaining to investigations from a variety of sources.- Conduct routine investigative work for attorney review.- Provide preliminary analysis of information to attorneys.- Confer with attorneys and other staff regarding investigation and litigation strategy.- Assist in the drafting, preparation, service and filing of pleadings, discovery demands, motion documents, transcripts of judgments, and other legal materials, including re-styling/re-formatting as necessary.- Assist in the review, organization and analysis of discovery materials.- Use electronic platforms, such as Relativity, to perform review of electronically stored information.- Perform legal research as directed by attorneys, including research utilizing electronic databases such as Westlaw or Lexis.- Assist with scheduling of depositions, hearings and trials, and preparation of attorneys and witnesses.- Assist at depositions, trials or hearings by managing the presentation of evidence and witnesses as directed by attorneys. - Calculate, verify, and maintain records of amounts due and owing in open cases to reflect accrual of costs and interest, receipt of partial payments, and other balance changes.- Track the filing and release of liens, executions, and other encumbrances on assets belonging to judgment debtors.- Routinely review bankruptcy status of judgment debtors, marking any changes in our internal tracking software and flagging for attorney review.- Maintain and oversee internal organizational and file tracking systems.- Perform activities related to docketing, the placement of court-related activities on the court calendar, and on attorney calendars.- Generate, maintain, and ensure accuracy of reports relating to work performed by the unit. - Assist in the preparation of training materials. - Perform other tasks as assigned.PREFERRED QUALIFICATIONS:Legal Assistant/Paralegal experience working with enforcement of judgments.
Minimum Qualifications NY HELPS: This title is part of the New York Hiring for Emergency Limited Placement Statewide Program (NY HELPS). For the duration of the NY HELPS Program, this title may be filled via a non-competitive appointment, which means no examination is required but all candidates must meet the minimum qualifications of the title for which they apply. At a future date (within one year of permanent appointment), it is expected employees hired under NY HELPS will have their non-competitive employment status converted to competitive status, without having to compete in an examination. Employees will then be afforded with all of the same rights and privileges of competitive class employees of New York State. While serving permanently in a NY HELPS title, employees may take part in any promotion examination for which they are qualified. NON-COMPETITIVE QUALIFICATIONS: A minimum of three years of full-time experience as a Paralegal/Legal Assistant (see "Definition" below).ORAn associate degree (or higher) in a Paralegal/Legal Assistant/Legal Studies program or a certificate in a Paralegal/Legal Assistant program where the degree was granted from a regionally accredited college or university or one approved by the American Bar Association (ABA) AND one year of full-time experience as a Paralegal/Legal Assistant (see "Definition" below).ORGraduation from an accredited (ABA approved) law school with a degree required for NYS Bar AND two years of full-time experience as a Paralegal/Legal Assistant (see "Definition" below).Definition: a Paralegal/Legal Assistant is someone who applies knowledge of the law and legal procedures in rendering direct assistance to lawyers, clients, and courts; prepares and interprets legal documents and forms; researches, compiles, and uses information from legal materials to provide both written and verbal comments on their findings; and analyzes and handles routine procedural problems independently with minimal attorney oversight.Examples of non-qualifying experience: receptionist, records clerk, bookkeeper, office manager.OTHER WAYS TO QUALIFY:Reachable on the Department of Civil Service Eligible list for Legal Assistant 2. OREligible for a lateral transfer or eligible for transfer under 52.6 or 70.1 of the Civil Service Law by having one year of permanent competitive service in an appropriate title. Additional Comments The agency's hours of operation are Monday through Friday, between 8:30 a.m. and 5:00 p.m. (37.5 hours/week). Scheduling determinations depend on the needs of the Bureau and will be communicated during interviews. For new State employees appointed to graded positions, the annual salary is the hiring rate (beginning of the Salary Range) of the position. Promotion salaries are calculated by the NYS Office of the State Comptroller (OSC) in accordance with NYS Civil Service Law, OSC Payroll rules and regulations, and negotiated union contracts.The Office of the NYS Attorney General (OAG) cannot provide sponsorship for work authorization.
