Work involves planning and implementing legal tasks, preparing legal documents, including contracts and rules, interpreting laws and regulations, and rendering legal advice and counsel. Works under minimal supervision with extensive latitude for the use of initiative and independent judgment.Advises staff on legal and regulatory aspects of procurement and contracting functions.
Reviews, revises, drafts, and negotiates solicitation and contract documents.
Interprets issues related to and advises staff on the application of laws and regulations that affect the agency, such as researching legal issues and advising staff on issues related to , rulemaking, litigation, HR, procurement, contracting, privacy, confidentiality, cybersecurity, technology, and relevant federal laws and rules.
Represents the agency in an effective manner by responding to the needs of the agency promptly and keeping up-to-date on legal issues related to the agencyand#8217;s business objectives.
Serves as the agency Public Information Officer, including the following specific job functions:Reviews public information requests;
Reviews responsive documents and drafts related correspondence and opinion requests; and
Assistsagency in complying with open records and open meetings laws and regulations.
Researches and prepares legal opinions, memos, correspondence, litigation documents, and other legal documents as necessary; reviews drafts of laws, rules, and regulations affecting agency operations and bills or amendments for legislative consideration.
Serves as the legal liaison to Human Resources; advises HR on employment law related issues.
Drafts or assists in the drafting and development of agency policies.
Provides legal advice and counsel on general legal matters affecting the agency.
Complete special projects for the General Counsel as assigned.
Performs other work-related duties as assigned.
Qualifications: EducationGraduation from an accredited law school with a J.D. degree
Must be licensed to practice law in the State of Texas
Must be a member in good standing of the State Bar of Texas.Experience and Training RequiredMinimum of twelve years of experience as a practicing and licensed attorney.
Minimum of nine years of experience providing legal support for a State of Texas governmental entity
Experience and Training Preferred
Experience drafting a variety of legal documents in various disciplines (in house or general counsel work)
Experience advising clients on all levels and skill sets
Experience with analyzing, implementing, and ensuring compliance with legislation and regulation
Experience with the Public Information Act as well as open meetings laws
Experience and familiarity with cybersecurity and privacy laws, such as CUBI, TRAIGA, TMRPA, HIPAA and HITECH
Experience with agency rulemaking and the APA
Experience drafting and negotiating contracts
Familiarity with applicable information technology laws and regulations
Familiarity with State of Texas procurement and contracting laws and best practicesKnowledge, Skills, and AbilitiesKnowledge of Texas state government, state legislative processes, and the state budget process
Excellent skill in communicating both verbally and in writing, in a clear and concise manner
