Duties Description The New York State Education Department's (NYSED) Office of the Professions is seeking to fill the position of Assistant Counsel position in the Office of the Professions. Under the direction of the Deputy Commissioner of the Office of the Professions, the Director of the Division of Legal Services will direct and oversee the work activities of the Office of Legal Services within the Office of Professional Responsibility (OPR), which regulates the discipline of professionals licensed by the Board of Regents. The Office of Legal Services also has a role in determinations of moral character and the license restoration process for individuals who have lost their professional license by revocation or surrender. Duties of the position will include, but not be limited to, the following:- Supervise the work of attorneys and staff who provide independent legal assistance and advice to the various State Boards of the Professions hearing panels in the key plenary hearings of the process: discipline hearings; moral character hearings for new licensees; and restoration hearings for those licensees previously revoked;- Provide oversight and direction for the legal advice to the Regents Review Committee, which hears numerous cases against professionals previously adjudicated guilty in certain other administrative and criminal proceedings; - Administer the processing of all the decisions, records and paperwork to the full Board of Regents for its final determination in discipline proceedings; - Draft and transmit the votes and orders from the Board of Regents, enforcing those determinations.- Maintain the flow of cases through the disciplinary process, and ensure that well-written and legally accurate draft decisions are prepared on behalf of hearing panels and the Regents Review Committee; - Effectively interacting with members of the Board of Regents and the various State professional boards, other SED staff, prosecuting and defense counsel, witnesses, and members of the public;- Administering tasks related to reviewing and transmitting consent orders and surrender applications (settlement documents) for presentation to the Board of Regents;- Supervise administrative staff responsible for various tasks vital to the professional regulation and discipline process, including scheduling of the proceedings which involve numerous participants, compiling and drafting the calendars for the hearings and the various levels of review; arranging hearing dates for the State Board hearings and the Regents Review Committee;- Provide advice and explanation related to the reports of the Regents Review Committee to the Board of Regents during Executive Session of the Professional Practice Committee;- Draft the preliminary press release for cases determined by the full Board of Regents;- Assist in the oversight and coordination of the Committee on the Professions' approval role in moral character proceedings;- Oversee the legal process by which a determination is made when an applicant indicates that there is a question of moral character;- Coordinate and conduct Committee on the Professions (COP) moral character panels in conjunction with appropriate staff and prepare COP hearing panel decisions which become part of the licensure record;- Manage the license restoration process, which involves individuals who have lost professional licenses by revocation or through the surrender of license as a disposition to a disciplinary proceeding;- Oversee and coordinate the receipt of restoration applications and supporting material and their presentation at three levels of hearing review processes and issuing hearing panel decisions in a timely manner;- Present the background and findings of the hearing panels to the Board of Regents during Executive Session of the Professional Practice Committee for final determination on the applications for license restoration; - Oversee staff development and training of the professional staff; and- Perform other duties as assigned.
Minimum Qualifications MINIMUM QUALIFICATIONS: Candidates must be admitted to the New York State Bar AND have seven years of relevant, post-graduate, progressively responsible experience.
Additional Comments CONDITIONS OF EMPLOYMENT: This position is in the exempt class and the incumbent will serve at the discretion of the Commissioner of Education. Salary will be commensurate with education and experience. Occasional same day or overnight State-wide travel will be required (10%). This position allows for the opportunity to telecommute up to 30% each bi-weekly pay period and is granted at the discretion of the supervisor and the appointing office.
