Summary This position is in the Contracting, Budget, Real Estate, and Leasing subgroup, a component of the Litigation and Administrative Practice Group in the Office of the General Counsel (OGC). The subgroup provides legal and policy advice to the Commission and the SEC's divisions and offices on a wide range of legal matters including procurement, appropriations, real estate, leasing and intellectual property, and defends the Commission in administrative and federal court litigation. Responsibilities The individual selected for this position will primarily handle matters related to contracts, appropriations, real property and leasing, and intellectual property. Typical duties: Provides legal advice to the SEC's Office of Acquisitions and other offices/divisions on all aspects of the Commission's award and administration of its government contracts and licensing agreements. Represents the Commission in bid protests before the Government Accountability Office (GAO) and in government contract claims litigation before the Civilian Board of Contract Appeals, and serves as second chair to Department of Justice (DOJ) in litigation before the U.S. Court of Federal Claims. Provides legal advice on appropriations law issues, including interpretation and application of the Anti-Deficiency Act and procedures in connection with lapses in funding. Provides legal advice related to SEC leases and related building operations issues for the SEC's D.C. headquarters and 10 regional offices. Advises on novel legal questions related to the agency's use of the Internet and social media platforms, including terms of use for external data sets. Provides legal advice to the SEC's Privacy Office, Office of the Chief Data Officer, and others on data protection initiatives and potential data breach incident response. Represents the Commission in external negotiations with contractors and other government agencies on contract terms, terms of service agreements, memoranda of understanding (MOUs), nondisclosure agreements, and related legal documents and agreements. Prepares legal memoranda and other written documents to convey information and analysis, and conveys information and analysis orally through briefings, consultations, and other presentations. BASIC REQUIREMENT: All applicants must possess the following J.D. or LL.B. degree --AND-- Active membership of the bar in good standing in any state, territory of the United States, the District of Columbia, or the commonwealth of Puerto Rico. SK-14: Applicant must have three year(s) of post J.D. work experience, two year(s) of which includes: Providing legal advice relating to the laws and regulations affecting federal agency operations, including (a) federal procurement, (b) appropriations law, and (c) at least one of the of the following additional disciplines: government leasing and real property; information technology/data security law; licensing (including drafting or reviewing terms of service or terms of use); or social media law; AND Representing federal agencies or federal government contractors in bid protests before the Government Accountability Office (GAO) and/or in contract claims litigation before Boards of Contract Appeals; AND Providing analysis of complex legal matters in writing, oral briefings, consultations, and presentations.
