Description of Job
Tax Conferee exists to plan and execute the state's programs of tax dispute resolution and tax litigation as directed by the Director of the CDOR, to relieve the Director of the burden for management of the program and the myriad of formal hearings on tax disputes. The incumbents review, evaluate, negotiate and take final agency action on tax disputes for all state taxes, and as trustee for the statutory home rule cities, counties, and special districts' sales and use taxes. The section negotiates, drafts, and executes settlement agreements between the Department and taxpayers to resolve disputes prior to litigation.
The section also coordinates the Department's participation in litigation with the Attorney General's Office for the disputes that are not settled. It helps interpret and implement legislatively and judicially mandated changes in tax laws. The section also provides assistance to other divisions of the Department of Revenue, cities and counties, individuals, and businesses in the interpretation, application, and administration of the Colorado Revised Statutes, regulations, case law, and all other promulgations of the Department of Revenue
This positionmeets with taxpayers and their representatives to discuss, evaluate and resolve tax protest issues for all CDOR administered taxes. Position makes independent and final agency actions by planning and conducting informal conferences and negotiations on behalf of the director. Position applies the principles and standards of accounting, auditing, and legal research to develop strategies for negotiations. Position provides a level of review between tax sections and formal hearings by reviewing the agency's tax assessment and refund denial actions for appropriateness; researching appropriate guidance and legal decisions that involves the evaluation of the history of specific legal authorities to determine their relevance under current authorities; and making a determination on the case being protested. Position is expected to identify the tax due under law, regulations, or sustainable facts; and propose and negotiate acceptable solutions in terms of a total tax collection perspective of the state or local tax authority. When cases are unable to be resolved at this level, position requests a formal hearing by the Executive Director and notifies the Attorney General's office of the requirement to assign an attorney. Position works with the assigned attorney general to represent the department and manage the case through pre-trial, trial, post-trial, and appeals. Positions also act as mediator for protests involving home rule cities. Position is also the senior authority level tax specialist that functions as a staff expert in tax cases.

Residency Requirement:

MINIMUM QUALIFICATIONS:
Experience Only: Six (6) years of relevant experience in state tax auditing, tax litigation, or tax return preparation which involved large multi-state or multi-national corporate tax returns requiring complex apportioning of income and/or combining of parent/subsidiary income ,or
Education and Experience: A combination of related education in Accounting, Business, Finance, Public Administration or Taxation and/or relevant professional experience in state tax auditing, tax litigation, or tax return preparation which involved large multi-state or multi-national corporate tax returns requiring complex apportioning of income and/or combining of parent/subsidiary income equal to six (6) years. Substitutions include Advanced degree (Master, LLM) in Accounting, Finance, or Taxation and/or Certified Public Accountant (CPA) license.

Preferred Qualifications:
The ideal candidate will possess the following skills:
Excellent interpersonal skills
Experience in legal/tax research
Excellent oral and written communication skills
A significant amount of high-level experience in tax auditing or tax litigation
Experience in a legal setting or legal proceedings litigating, negotiation, or resolving disputes
An active Colorado Certified Public Accountant (CPA) license or Master of Taxation or LLM in Taxation
Excellent skills with Microsoft Office & Google Suite products
Familiarity with GenTax
Conditions of Employment with the CDOR:
Employees are in a position of public trust in the performance of their job duties and must operate in a manner that maintains the highest standards of honesty, integrity, and public confidence.
As a condition of employment with the CDOR, all personnel must file all necessary Colorado Individual Income Tax (CIIT) returns and pay tax obligations, therefore all employees must undergo a pre-employment evaluation of their tax records/accounts to ensure compliance with this policy. Final candidates must also complete a successful background investigation and reference check prior to appointment. Certain positions based on duties may require scheduled background investigations.
Pursuant to the Universal Driving Standards Policy (https://osc.colorado.gov/sites/osc/files/documents/Universal%20Policy%20Driving%20Standards.pdf) , any worker who will be expected to drive a State-owned vehicle is responsible for maintaining a safe driving record and a valid driver license prior to driving any State-owned vehicle.
To be compliant with the new fleet vehicle policy, Motor Vehicle Records (MVRs) will be pulled for review for workers who:
Have an assigned State fleet vehicle
Are required to operate a vehicle as part of the position
Utilize a State fleet vehicle as a pool vehicle
