What You Will Do
We are seeking a highly skilled Export Controls and Data Security Attorney with expertise in U.S. export control regulations, including the Export Administration Regulations (EAR), International Traffic in Arms Regulations (ITAR), and the Atomic Energy Act (AEA). The ideal candidate will have experience advising on the full spectrum of data security including protection of classified material, Controlled Unclassified Information, including Unclassified Controlled Nuclear Information, Personally Identifiable Information, etc. The candidate should have general familiarity with the Federal Privacy Act of 1974, state privacy statutes, the European Union's General Data Protection Regulation, Freedom of Information Act, etc.
This position will report to the Associate General Counsel for Intellectual Property, Environment and Regulatory (GC-IPER), and in this role, will be responsible for providing legal advice to ensure compliance with all applicable export control and data security statutory, regulatory, and Prime Contract requirements. This position will also provide legal guidance on international trade compliance, advise internal stakeholders on regulatory obligations, and implement risk mitigation strategies to ensure compliance with U.S. and international laws governing the export of defense, dual-use, and nuclear-related items.
Provide expert legal counsel on EAR, ITAR, and AEA compliance related to export-controlled goods, technology, software, and services.
Advise on classified data handling and ensure compliance with security regulations governing controlled information.
Provide expert legal advice on the full spectrum of data security including protection of classified material, Controlled Unclassified Information, including Unclassified Controlled Nuclear Information, Personally Identifiable Information, Federal Privacy Act of 1974, state privacy statutes, the European Union's General Data Protection Regulation, Freedom of Information Act, etc.
Conduct export control classifications, jurisdiction determinations, and license applications for controlled items.
Provide advice related to corporate export compliance policies, procedures, and training programs to ensure adherence to regulatory requirements.
Assist with the preparation and submission of export licenses, Technical Assistance Agreements (TAAs), Commodity Jurisdiction (CJ) requests, and Voluntary Self-Disclosures (VSDs) to the Bureau of Industry and Security (BIS), Directorate of Defense Trade Controls (DDTC), and Department of Energy (DOE) as needed.
Provide legal support for internal investigations, audits, and risk assessments related to export compliance violations or concerns.
Monitor regulatory updates and provide strategic guidance on changes to export control and data security laws.
Collaborate with cross-functional teams, including cross-national security enterprise, Compliance, Engineering, Security, and Government Affairs, to address regulatory risks and requirements.
Interface with U.S. government agencies (e.g., BIS, DDTC, DOE, DOD, and NNSA) on export control matters and compliance inquiries.
Represent the company in legal proceedings, regulatory filings, and government audits related to export controls and data security.
What You Need
Minimum Job Requirements:
Prior experience working in a law firm, corporate legal department, or government agency with a focus on export controls and data security.
Demonstrated experience in providing advice to a complex research & development organization in export controls and data security compliance.
Communication and Customer Interactions
Advanced oral, written and interpersonal communication and negotiation skills.
Effective knowledge of the Rules Governing the Practice of Law and the ability to recognize and resolve ethical issues and strict adherence to attorneys' rules of confidentiality required.
Operational knowledge of software applications and technologies used in a technologically sophisticated law office.
Education/Experience : Position requires a Juris Doctorate Degree from an ABA accredited law school, being an active member of a bar in good standing with the State Bar of New Mexico or another state bar, if licensed in a state other than New Mexico, you must become a member of the New Mexico State Bar or apply and receive an In-House Counsel Limited License pursuant to Rule 15-308 NMRA within one year of hire, and must have at least 12 years of experience in their specialty area after passing the bar and being admitted to practice.
Significant experience at this or another Department of Energy facility or significant experience representing similar corporate and/or government clients is preferred.

Prior productive interaction with federal, state, and local agencies; partner counsels; and particularly with the Department of Energy (DOE) and/or NNSA.
Working knowledge of DOE/NNSA M&O Prime Contract requirements.
Experience managing outside counsel.
Working knowledge of DOE/NNSA laboratories, plants, and sites organizational structure, policies, processes and procedures.
Active Q/SCI Clearance
Work Location: The work location for this position is hybrid and is located in Los Alamos. Hybrid is defined as working partially onsite/partially offsite but within 2 hours ground commute of this location. All work locations are at the discretion of management and can change at any time with appropriate notice.
Position commitment: Regular appointment employees are required to serve a period of continuous service in their current position in order to be eligible to apply for posted jobs throughout the Laboratory. If an employee has not served the time required, they may only apply for Laboratory jobs with the documented approval of their Division Leader. The position commitment for this position is 1 year.

Directive 206.2 - Employment with Triad requires a favorable decision by NNSA indicating employee is suitable under NNSA Supplemental Directive 206.2 (https://directives.nnsa.doe.gov/supplemental-directive/sd-0206-0002) . Clearance: Q/SCI (Position will be cleared to this level). Selected applicants will be subject to a background investigation conducted by or on behalf of the Federal Government, and must meet eligibility requirements* for access to classified matter. This position requires a Q clearance. and obtaining such clearance requires US Citizenship except in extremely rare circumstances. Dependent upon the position, additional authorization to access classified information may be required, which may or may not be available to dual citizens. Receipt of a Q clearance and additional access authorization ultimately is a decision of the Federal Government and not of Triad.
*Eligibility requirements: To obtain a clearance, an individual must be at least 18 years of age; U.S. citizenship is required except in very limited circumstances. New-Employment Drug Test: The Laboratory requires successful applicants to complete a new-employment drug test and maintains a substance abuse policy that includes random drug testing. Although New Mexico and other states have legalized the use of marijuana, use and possession of marijuana remain illegal under federal law.
