S ummary
The Director of Construction Contracts is responsible for supporting procurements relating to the MTA ' s capital program. This includes supporting the award of $2-3 billion in new construction contracts per year and supporting the management of claims and changes on contracts valued at approximately $5 billion . The Director will have decision - making authority and staffing oversight responsibilities to accomplish these objectives. The Director will also be required to provide input into the overall strategy and approach for the contracts they manage and to recommend and, in consulta tion with senior officers, implement policy and procedural changes for the betterment of the Contracts Department.
Responsibilities
Manages processes, drafts, reviews , and edits procurement documents for accuracy and ensures that contract files properly document the procurement and decision-making process needed for the efficient operation of the Contracts Department .
Manage s and track s procurements and awards against approved timelines to support the needs and time requirements of the MTA ' s capital program
Create s and implement s contract and procurement documentation to support the award of contracts.
Draft s and review s innovative construction contracts involving A+B bidding, design-build, progressive-design build, public - private partnerships, and other state -of-the- art construction contracting methods to support the MTA ' s Capital Program .
Remain s current with trends necessary to deliver cogent, enforceable construction and construction - related contracts designed to achieve and deliver desired project benefits.
Provide s guidance to agency staff on the regulations and polic i es on public works contracting and communicate s the MTA ' s position on these issues to the MTA ' s funding partners, such as the NYS Office of Management and Budget, FTA , and FRA.
Create and contribute to reports and presentations generated for MTA agency executives and senior staff on matters related to delivering the MTA ' s capital program .
Education and Experience
Bachelor ' s degree in Engineering , A rchitecture, Finance, Government Contracting , or another related field.
Minimum of ten ( 10 ) years of related experience .
Minimum of six ( 6 ) years ' experience in a management or supervisory role.
Competencies:
Substantial experience working in and with public sector procurement management principles, government project administration, and government bid process .
Proven experience working on matters involving public works projects, construction projects , and/or real estate matters .
Demonstrated ability and experience working with executive management, board members, elected officials , and other government, non - profit , or corporate stakeholders .
Substantial knowledge of contract terminology, terms and conditions, procurement, and construction management (including the ability to interpret contract documents and schedules) .
Familiarity and experience with relevant local, state, and federal laws, including federal and state procurement laws, rules, and regulations .
Accountable for planning, organizing, directing, coordinating, and reviewing risk management and assessment activities.
Responsible for preparing project risk assessment reports and presenting risk results/recommendations of project contingencies/risk reserves.
Responsible for reviewing contract drawings and specifications a n d commenting on complete n ess and general compliance with commonly accepted architectural /engineering best practices
Analyze direct and indirect cost budget , including cost estimate back-up , and coordinate with estimating professionals for spot check quantity take-offs and review of supporting documenta ti on.
Review and make relevant comments concerning the terms of the construction agreement and related documents.
Review and comment on project schedules , spot-check productivity rates , and other submitted documents.
Facilitate risk assessment workshops with stakeholders throughout the project life.
Develop and recommend risk mitigation plans and actions , and mo ni tor progress.
Strong interpersonal, analytical, problem - solving, organizational, negotiation , and communication skills .
Ability to comprehend, analyze , and interpret complex business documents .
Proficient in Microsoft Office Suite and document management software .
