Direct Care and Treatment (DCT) is hiring an Assistant Deputy General Counsel - Staff Attorney Supervisor to join our General Counsel's Office (GCO). This role offers a rewarding opportunity to provide legal expertise to DCT leadership, with a focus on Mental Health & Substance Abuse Treatment Services (MHSATS), Community Based Services (CBS), Ambulatory Care (AC), DCT Pharmacy, Medical Services, Forensic Services (FS), and occasionally the Minnesota Sex Offender Program (MSOP).
You will supervise attorneys serving these areas and provide legal guidance on complex issues, including civil commitments, treatment and discharge planning, data privacy, protected health information, facility operations, due process in treatment decisions, criminal procedure, employment law, litigation, legislation, and regulatory compliance. This position also involves legal support for state-operated behavioral health programs such as psychiatric hospitals and residential treatment facilities.
Primary Responsibilities:
Lead and supervise the team of attorneys, who provide legal services to the MHSATS, CBS, AC, DCT Pharmacy, DCT Medical Services and FS areas of DCT.
Using knowledge of case law, statutes, and how courts apply law to facts, provide legal advice to managers and executives on various topics within DCT, with a focus on civilly committed individuals and the operation of state-operated behavioral health care programs and services.
Using knowledge of substantive law and policy, provide analysis, legislation drafting, and related writing to support DCT legislative objectives, with particular emphasis on issues connected with civil commitment and state-operated behavioral health care programs and services.
Monitor litigation involving DCT to coordinate litigation-related information and activities in support of favorable outcomes for the Department, with particular emphasis on litigation connected with MHSATS, CBS, AC, DCT Pharmacy, DCT Medical Services, and FS.

Minimum Qualifications
Demonstrated leadership experience. Leadership experience can include:
Experience as a supervisor, lead worker, team lead, project lead.
Completion of a State of Minnesota leadership program (e.g. ELI, L4).
A paid/unpaid position leading a program or chairing a committee (e.g. ERG) - experience must include:
1+ year of experience identifying issues, goals and strategic actions
100+ hours per year time commitment
AND
Juris Doctorate (JD) degree from an ABA accredited law school.
Current license and in good standing to practice law in Minnesota.
Five (5) years' experience as a practicing attorney in an area of law related to the position. Experience must demonstrate the following:
Experience with strong legal research, analysis, and writing skills.
Experience building and maintaining good working relationships with internal and external stakeholders.
Experience providing legal advice to executive leadership on diverse and complex matters.
Preferred Qualifications
Variety of experiences working effectively with others from different backgrounds and cultures.
Possess knowledge of state and federal laws, rules, and regulations relating to the Minnesota Commitment and Treatment Act, the Minnesota Health Records Act, Minnesota mandated reporting statutes, guardianship statutes, employment law, labor law, affirmative action/equal opportunity, criminal procedure, the Health Insurance Portability and Accountability Act, and the Minnesota Government Data Practices Act.
Experience identifying statutes and rules that apply to individual situations and experience advising decision-makers of the legal consequences for actions or failures to act in compliance with applicable statutes and rules.
Experience determining the impact of proposed or adopted changes in state or federal law, rule or regulation that impact DCT services, clients, and staff.
